1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to the application of the open meetings law to certain
1-24 municipal boards, commissions, and committees.
1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-26 SECTION 1. Subchapter A, Chapter 211, Local Government Code,
1-27 is amended by adding Section 211.0075 to read as follows:
1-28 Sec. 211.0075. COMPLIANCE WITH OPEN MEETINGS LAW. A board
1-29 or commission established by an ordinance or resolution adopted by
1-30 the governing body of a municipality to assist the governing body
1-31 in developing an initial comprehensive zoning plan or initial
1-32 zoning regulations for the municipality, or a committee of the
1-33 board or commission that includes one or more members of the board
1-34 or commission, is subject to the open meetings law, Chapter 271,
1-35 Acts of the 60th Legislature, Regular Session, 1967 (Article
1-36 6252-17, Vernon's Texas Civil Statutes), regardless of whether the
1-37 board, commission, or committee has rulemaking or quasi-judicial
1-38 powers or functions only in an advisory capacity.
1-39 SECTION 2. The importance of this legislation and the
1-40 crowded condition of the calendars in both houses create an
1-41 emergency and an imperative public necessity that the
1-42 constitutional rule requiring bills to be read on three several
1-43 days in each house be suspended, and this rule is hereby suspended.
