   1-17                         A BILL TO BE ENTITLED
   1-18                                AN ACT
   1-19  relating to the title to certain property exempt from the statewide
   1-20  personal property accounting system or in the possession of certain
   1-21  entities providing emergency medical services.
   1-22        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-23        SECTION 1.  Subchapter E, Chapter 12, Health and Safety Code,
   1-24  is amended by adding Section 12.054 to read as follows:
   1-25        Sec. 12.054.  DISPOSITION OF CERTAIN DEPARTMENT PROPERTY.
   1-26  (a)  This section applies only to property that is surplus or
   1-27  salvage property under Article 9, State Purchasing and General
   1-28  Services Act (Article 601b, Vernon's Texas Civil Statutes), and
   1-29  that is:
   1-30              (1)  exempt under Section 12.053 from the statewide
   1-31  personal property accounting system; or
   1-32              (2)  lawfully in the possession of an emergency medical
   1-33  services provider or governmental entity as those terms are defined
   1-34  by Section 773.003.
   1-35        (b)  The department may negotiate directly with an emergency
   1-36  medical services provider or governmental entity to transfer title
   1-37  to property covered by this section for which the department
   1-38  determines that it holds title.  The department and the provider or
   1-39  governmental entity may mutually agree upon the value of the
   1-40  property and shall take any action incident to the transaction that
   1-41  is required by federal law.
   1-42        (c)  The department shall initiate necessary procedures under
   1-43  Article 9, State Purchasing and General Services Act (Article 601b,
   1-44  Vernon's Texas Civil Statutes), to dispose of surplus or salvage
   1-45  property for which the department does not transfer title under
   1-46  this section.
   1-47        SECTION 2.  This Act takes effect September 1, 1993.
   1-48        SECTION 3.  The importance of this legislation and the
   1-49  crowded condition of the calendars in both houses create an
   1-50  emergency   and   an   imperative   public   necessity   that   the
   1-51  constitutional rule requiring bills to be read on three several
   1-52  days in each house be suspended, and this rule is hereby suspended.
