No. 84 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the disposal of certain authorized emergency vehicles; 1-3 providing a penalty. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. DEFINITIONS. In this Act: 1-6 (1) "Authorized emergency vehicle" has the meaning 1-7 assigned by Section 2, Uniform Act Regulating Traffic on Highways 1-8 (Article 6701d, Vernon's Texas Civil Statutes). 1-9 (2) "Vehicle equipment" has the meaning assigned by 1-10 Section 108, Uniform Act Regulating Traffic on Highways (Article 1-11 6701d, Vernon's Texas Civil Statutes). 1-12 SECTION 2. CERTAIN EQUIPMENT TO BE REMOVED. The owner of an 1-13 authorized emergency vehicle that is used to transport sick or 1-14 injured persons may not transfer ownership of the vehicle, unless 1-15 the owner of the vehicle: 1-16 (1) removes from the vehicle any vehicle equipment, 1-17 including a light, siren, or device, that under the Uniform Act 1-18 Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil 1-19 Statutes) only an authorized emergency vehicle may be equipped 1-20 with; and 1-21 (2) removes or obliterates any emblem or marking on 1-22 the vehicle that identifies the vehicle as an authorized emergency 1-23 vehicle. 1-24 SECTION 3. NONAPPLICABLE. Section 2 of this Act does not 2-1 apply if the owner of the authorized emergency vehicle transfers 2-2 ownership of the vehicle to an entity described in Section 2(d), 2-3 Uniform Act Regulating Traffic on Highways (Article 6701d, Vernon's 2-4 Texas Civil Statutes). 2-5 SECTION 4. OFFENSE. A person who violates Section 2 of this 2-6 Act commits an offense. An offense under this section is a Class C 2-7 misdemeanor. 2-8 SECTION 5. EFFECTIVE DATE. This Act takes effect September 2-9 1, 1993, and applies only to a transfer of ownership of an 2-10 authorized emergency vehicle made on or after that date. 2-11 SECTION 6. EMERGENCY. The importance of this legislation 2-12 and the crowded condition of the calendars in both houses create an 2-13 emergency and an imperative public necessity that the 2-14 constitutional rule requiring bills to be read on three several 2-15 days in each house be suspended, and this rule is hereby suspended.
