   1-21  COMMITTEE AMENDMENT NO. 1                               By:  Sibley
   1-22  Amend H.B. 84 by striking SECTION 3 and replacing it with a new
   1-23  SECTION 3 to read as follows:
   1-24        SECTION 3.  NONAPPLICABLE.  Section 2 of this Act does not
   1-25  apply if the owner of the authorized emergency vehicle transfers
   1-26  ownership of the vehicle to:
   1-27              (1)  a person who holds a license as a emergency
   1-28  medical services provider under Chapter 773, Health and Safety
   1-29  Code,
   1-30              (2)  a person who is in the business of buying and
   1-31  selling used vehicles in this state and specializes in authorized
   1-32  emergency vehicles, or
   1-33              (3)  an entity described in Section 2 (d), Uniform Act
   1-34  Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil
   1-35  Statutes), or to similar entities operating in foreign countries.
   1-36                         A BILL TO BE ENTITLED
   1-37                                AN ACT
   1-38  relating to the disposal of certain authorized emergency vehicles;
   1-39  providing a penalty.
   1-40        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-41        SECTION 1.  DEFINITIONS.  In this Act:
   1-42              (1)  "Authorized emergency vehicle" has the meaning
   1-43  assigned by Section 2, Uniform Act Regulating Traffic on Highways
   1-44  (Article 6701d, Vernon's Texas Civil Statutes).
   1-45              (2)  "Vehicle equipment" has the meaning assigned by
   1-46  Section 108, Uniform Act Regulating Traffic on Highways (Article
   1-47  6701d, Vernon's Texas Civil Statutes).
   1-48        SECTION 2.  CERTAIN EQUIPMENT TO BE REMOVED.  The owner of an
   1-49  authorized emergency vehicle that is used to transport sick or
   1-50  injured persons may not transfer ownership of the vehicle, unless
   1-51  the owner of the vehicle:
   1-52              (1)  removes from the vehicle any vehicle equipment,
   1-53  including a light, siren, or device, that under the Uniform Act
   1-54  Regulating Traffic on Highways (Article 6701d, Vernon's Texas Civil
   1-55  Statutes) only an authorized emergency vehicle may be equipped
   1-56  with; and
   1-57              (2)  removes or obliterates any emblem or marking on
   1-58  the vehicle that identifies the vehicle as an authorized emergency
   1-59  vehicle.
   1-60        SECTION 3.  NONAPPLICABLE.  Section 2 of this Act does not
   1-61  apply if the owner of the authorized emergency vehicle transfers
   1-62  ownership of the vehicle to an entity described in Section 2(d),
   1-63  Uniform Act Regulating Traffic on Highways (Article 6701d, Vernon's
   1-64  Texas Civil Statutes).
   1-65        SECTION 4.  OFFENSE.  A person who violates Section 2 of this
   1-66  Act commits an offense.  An offense under this section is a Class C
   1-67  misdemeanor.
   1-68        SECTION 5.  EFFECTIVE DATE.  This Act takes effect September
    2-1  1, 1993, and applies only to a transfer of ownership of an
    2-2  authorized emergency vehicle made on or after that date.
    2-3        SECTION 6.  EMERGENCY.  The importance of this legislation
    2-4  and the crowded condition of the calendars in both houses create an
    2-5  emergency   and   an   imperative   public   necessity   that   the
    2-6  constitutional rule requiring bills to be read on three several
    2-7  days in each house be suspended, and this rule is hereby suspended.
