                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the representation of college and university students
    1-3  on the governing boards of their university systems.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subtitle B, Title 3, Education Code, is amended
    1-6  by adding Chapter 63 to read as follows:
    1-7                CHAPTER 63.  STUDENT REPRESENTATION ON
    1-8                           GOVERNING BOARDS
    1-9                   SUBCHAPTER A.  GENERAL PROVISIONS
   1-10        Sec. 63.01.  DEFINITIONS.  In this chapter:
   1-11              (1)  "Member school" means a general academic teaching
   1-12  institution or a medical and dental unit, as those terms are
   1-13  defined by Section 61.003 of this code.
   1-14              (2)  "University system" has the meaning assigned by
   1-15  Section 61.003(10) of this code.
   1-16              (3)  "Governing board" or "board" has the meaning
   1-17  assigned by Section 61.003(9) of this code.
   1-18             (Sections 63.02-63.10 reserved for expansion
   1-19               SUBCHAPTER B.  ADMINISTRATIVE PROVISIONS
   1-20        Sec. 63.11.  ADVISORY STUDENT LIAISON.  If the students of
   1-21  any member school choose to participate in the program under this
   1-22  chapter, the governing board of each university system shall
   1-23  include a nonvoting advisory student liaison, selected as provided
   1-24  by this subchapter.
    2-1        Sec. 63.12.  QUALIFICATIONS; TERMS.  The advisory student
    2-2  liaison nominee must be a qualified voter.  The advisory student
    2-3  liaison serves for a term of one year, beginning on September 1.
    2-4        Sec. 63.13.  SCHOOLS LACKING STUDENT GOVERNMENT.  At member
    2-5  schools lacking student government, any duty assigned by this
    2-6  chapter to the student government shall be performed by the general
    2-7  student population through referendum.
    2-8        Sec. 63.14.  OPTIONAL PARTICIPATION.  No member school shall
    2-9  participate in the program under this chapter unless the students
   2-10  of the member school choose to participate through their student
   2-11  government.  The student government of a member school may remove
   2-12  the school from program participation.
   2-13        Sec. 63.15.  NOMINATION AND SELECTION IN MULTISCHOOL SYSTEMS.
   2-14  (a)  The student government of each member school of a university
   2-15  system consisting of more than one member school shall select
   2-16  representatives to sit on the system's student advisory council
   2-17  under Section 63.31 of this code.  The entire membership of the
   2-18  council shall then nominate three members for the position of
   2-19  advisory student liaison.   The nominations shall be forwarded to
   2-20  the governor not later than June 1 of each year.
   2-21        (b)  The advisory student liaison for each university system
   2-22  consisting of more than one member school shall be selected by the
   2-23  governor from a list composed of the nominations from the student
   2-24  advisory council.  The selections shall be announced by the
   2-25  governor not later than August 1 of each year.
   2-26        Sec. 63.16.  NOMINATION AND SELECTION IN SINGLE-SCHOOL
   2-27  SYSTEMS.  (a)  The student government of a member school in a
    3-1  university system consisting of only one member school shall
    3-2  nominate three students for the position of advisory student
    3-3  liaison.  One of the nominees may be that school's student
    3-4  government president.  The nominations shall be forwarded to the
    3-5  governor not later than June 1 of each year.
    3-6        (b)  The advisory student liaison for each single-school
    3-7  university system shall be selected by the governor from a list
    3-8  composed of the nominations of the member school.  The selections
    3-9  shall be announced by the governor not later than August 1 of each
   3-10  year.
   3-11        Sec. 63.17.  CERTIFICATE OF APPOINTMENT.  The secretary of
   3-12  state shall forward a certificate to the advisory student liaison
   3-13  for each university system within 10 days after the appointment,
   3-14  notifying the student of the appointment.  If any person so
   3-15  appointed and notified fails for 10 days to give notice to the
   3-16  governor of acceptance, the appointment is void and the place shall
   3-17  be filled from the remaining students on the nomination list.
   3-18        Sec. 63.18.  EXPENSES OF ADVISORY STUDENT LIAISON.  An
   3-19  advisory student liaison of each university system serves without
   3-20  compensation, and any costs incurred shall be paid by the student
   3-21  regent or from revenue collected from the student services fee.
   3-22             (Sections 63.19-63.20 reserved for expansion
   3-23     SUBCHAPTER C.  POWERS AND DUTIES OF ADVISORY STUDENT LIAISON
   3-24        Sec. 63.21.  NONVOTING LIAISON TO THE BOARD.  (a)  The
   3-25  advisory student liaison shall represent the interests of
   3-26  university system students and provide insight to the board as to
   3-27  the perspective of system students.
    4-1        (b)  An advisory student liaison has the same rights as any
    4-2  board member to voice opinions, to make recommendations, or to
    4-3  participate in all board meetings, except that an advisory student
    4-4  liaison is not entitled to vote on any matter before the board.  An
    4-5  advisory student liaison may not be included in an executive
    4-6  meeting of the board.
    4-7        Sec. 63.22.  ATTENDANCE ON BOARD MEETINGS.  An advisory
    4-8  student liaison shall attend each meeting of the governing board.
    4-9  Failure to attend two consecutive board meetings voids the
   4-10  appointment of the advisory student liaison.  The student's place
   4-11  shall be filled from the remaining student advisory council
   4-12  members.
   4-13             (Sections 63.23-63.30 reserved for expansion
   4-14            SUBCHAPTER D.  SYSTEM STUDENT ADVISORY COUNCIL
   4-15        Sec. 63.31.  SYSTEM STUDENT ADVISORY COUNCIL.  Each member
   4-16  school of a university system consisting of more than one member
   4-17  school shall be represented on a system student advisory council.
   4-18  The student  advisory council shall consist of two student
   4-19  representatives from each member school, and institutions with
   4-20  doctoral programs may send a third representative.  One of the
   4-21  representatives from a member school may be that school's student
   4-22  government president.  The member school's representatives to the
   4-23  student advisory council shall be chosen not later than April 1 of
   4-24  each year.
   4-25        Sec. 63.32.  POWERS AND DUTIES OF THE COUNCIL.  The system
   4-26  advisory council shall meet on a schedule to be determined by the
   4-27  council members to ensure that the advisory student liaison is
    5-1  aware of the concerns of the students of each member school.  The
    5-2  council shall meet before June 1 of each year to select the student
    5-3  advisory liaison nominees to be presented to the governor.  The
    5-4  council shall meet at least once before the first governing board
    5-5  meeting of each year following the certification of and acceptance
    5-6  by the advisory student liaison.
    5-7        Sec. 63.33.  CHAIRMAN OF THE SYSTEM ADVISORY COUNCIL.  The
    5-8  system advisory council for each university system shall be chaired
    5-9  by the advisory student liaison for that university system.
   5-10        Sec. 63.34.  ATTENDANCE AT SYSTEM ADVISORY COUNCIL MEETINGS.
   5-11  Each advisory council member shall attend each meeting of the
   5-12  council.  Failure to attend two consecutive council meetings voids
   5-13  the membership of the absent member, and the place shall be filled
   5-14  by nomination of the member school under Section 63.15(a) of this
   5-15  code.  If the absent member is the advisory student liaison, the
   5-16  member's position as advisory student liaison is also forfeited and
   5-17  shall be filled from the remaining council members, subject to the
   5-18  restrictions under Subchapter B of this chapter.
   5-19        SECTION 2.  The importance of this legislation and the
   5-20  crowded condition of the calendars in both houses create an
   5-21  emergency and an imperative public necessity that the
   5-22  constitutional rule requiring bills to be read on three several
   5-23  days in each house be suspended, and this rule is hereby suspended,
   5-24  and that this Act take effect and be in force from and after its
   5-25  passage, and it is so enacted.
