No. 104 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to research fees charged by libraries in the state library 1-3 system. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter I, Chapter 441, Government Code, is 1-6 amended by adding Section 441.139 to read as follows: 1-7 Sec. 441.139. RESEARCH FEES FOR FOR-PROFIT ENTITIES. (a) 1-8 Notwithstanding other provisions of this subchapter, a library, 1-9 including a public library, may charge a reasonable fee to a 1-10 for-profit business entity for providing in-depth research services 1-11 or research support relating to the entity's business activities. 1-12 (b) A library may not charge a fee under this section in 1-13 circumstances under which charging a fee is not allowed by federal 1-14 law for federal funding purposes. 1-15 SECTION 2. This Act takes effect September 1, 1993. 1-16 SECTION 3. The importance of this legislation and the 1-17 crowded condition of the calendars in both houses create an 1-18 emergency and an imperative public necessity that the 1-19 constitutional rule requiring bills to be read on three several 1-20 days in each house be suspended, and this rule is hereby suspended. 1-21 COMMITTEE AMENDMENT NO. 1 1-22 Amend H.B. 104, Section 441.139(a) to read as follows: 1-23 Sec. 441.139. RESEARCH FEES FOR FOR-PROFIT ENTITIES. (a) 1-24 Notwithstanding other provisions of the subchapter, a library, 2-1 including a public library, in a city with a population of 2-2 1,000,000 or more and that has adopted a council-managed form of 2-3 government, may charge a reasonable fee to a for-profit business 2-4 entity for providing in-depth research services or research support 2-5 relating to the entity's business activities. 2-6 Averitt
