                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the resignation of a teacher with a continuing or
    1-3  probationary contract.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 13.116(a), Education Code, is amended to
    1-6  read as follows:
    1-7        (a)  Any teacher holding a continuing contract with any
    1-8  school district, or holding a probationary contract with an
    1-9  unexpired term continuing through the ensuing school year, may
   1-10  relinquish the position and leave the employment of the district at
   1-11  the end of any school year without penalty by written resignation
   1-12  addressed to and filed with the board of trustees prior to July 15
   1-13  <August 1>, preceding the end of the school year that the
   1-14  resignation is to be effective.  A written resignation mailed by
   1-15  prepaid certified or registered mail to the superintendent of
   1-16  schools of the district at the post office address of the district
   1-17  shall be considered filed at time of mailing.
   1-18        SECTION 2.  This Act applies beginning with the 1993-1994
   1-19  school year.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency   and   an   imperative   public   necessity   that   the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
