                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the name of The University of Texas--Pan American.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 77.01(2), Education Code, is amended to
    1-5  read as follows:
    1-6              (2)  "University" means The University of Texas at
    1-7  Edinburg<--Pan American>.
    1-8        SECTION 2.  Section 77.11, Education Code, is amended to read
    1-9  as follows:
   1-10        Sec. 77.11.  The University of Texas AT EDINBURG<--PAN
   1-11  AMERICAN>.  The University of Texas at Edinburg<--Pan American> is
   1-12  a coeducational institution of higher education located in the City
   1-13  of Edinburg.  The university is a component institution of The
   1-14  University of Texas System under the governance, management, and
   1-15  control of the Board of Regents of The University of Texas System.
   1-16        SECTION 3.  Section 77.13, Education Code, is amended to read
   1-17  as follows:
   1-18        Sec. 77.13.  Gifts and Grants.  The board may accept and
   1-19  administer, on terms and conditions acceptable to it, gifts,
   1-20  grants, or donations of any kind and from any source for use by The
   1-21  University of Texas at Edinburg<--Pan American>.
   1-22        SECTION 4.  Section 55.172, Education Code, is amended to
   1-23  read as follows:
   1-24        Sec. 55.172.  The University of Texas AT EDINBURG<--PAN
    2-1  AMERICAN>.  (a)  The board of regents of The University of Texas
    2-2  System may construct and equip academic buildings, structures, and
    2-3  facilities for The University of Texas at Edinburg<--Pan American>,
    2-4  following approval for such construction by the Texas Higher
    2-5  Education Coordinating Board and for these purposes may issue
    2-6  revenue bonds pursuant to this subchapter.  The board may pledge
    2-7  irrevocably to the payment of these revenue bonds all or any part
    2-8  of the aggregate amount of student tuition charges required or
    2-9  authorized by law to be imposed on students enrolled at The
   2-10  University of Texas at Edinburg<--Pan American>; and the amount of
   2-11  any pledge so made shall never be reduced or abrogated while the
   2-12  bonds are outstanding.  However, the tuition charges shall not be
   2-13  pledged pursuant to the authority granted by this subsection except
   2-14  to the payment of bonds issued in an aggregate principal amount not
   2-15  to exceed $10 million for the purpose of providing funds to
   2-16  construct and equip academic buildings, structures, and facilities
   2-17  for The University of Texas at Edinburg<--Pan American>.
   2-18        (b)  It is provided, however, that no bonds shall be issued
   2-19  hereunder and no tuition shall be pledged thereto unless and until
   2-20  the specific terms and provisions of said bonds and pledge have
   2-21  been first approved by the Texas Higher Education Coordinating
   2-22  Board in accordance with rules and regulations regarding that
   2-23  subject adopted, published, and heard in accordance with Section
   2-24  61.027 of this code.
   2-25        SECTION 5.  Section 61.003(3), Education Code, is amended to
   2-26  read as follows:
   2-27              (3)  "General academic teaching institution" means The
    3-1  University of Texas at Austin; The University of Texas at El Paso;
    3-2  The University of Texas of the Permian Basin; The University of
    3-3  Texas at Dallas; The University of Texas at San Antonio; Texas A&M
    3-4  University, Main University; The University of Texas at Arlington;
    3-5  Tarleton State College; Prairie View Agricultural and Mechanical
    3-6  College; Texas Maritime Academy; Texas Tech University; University
    3-7  of North Texas; Lamar University; Texas A&I University; Texas
    3-8  Woman's University; Texas Southern University; Midwestern
    3-9  University; University of Houston; The University of Texas at
   3-10  Edinburg <Pan American University>; The University of Texas at
   3-11  Brownsville; East Texas State University; Sam Houston State
   3-12  University; Southwest Texas State University; West Texas State
   3-13  University; Stephen F. Austin State University; Sul Ross State
   3-14  University; Angelo State University; Tyler State College; and any
   3-15  other college, university, or institution so classified as provided
   3-16  in this chapter or created and so classified, expressly or
   3-17  impliedly, by law.
   3-18        SECTION 6.  Section 12.1105(e), Parks and Wildlife Code, is
   3-19  amended to read as follows:
   3-20        (e)  The Parks and Wildlife Department, when requested by
   3-21  authorized representatives of units of The University of Texas
   3-22  System, The Texas A&M University System, the Texas A&I University
   3-23  System, The University of Texas at Edinburg <Pan American
   3-24  University>, the Lamar University System, and Southwest Texas State
   3-25  University, engaged in teaching and research related to marine
   3-26  science and oceanography, may transfer to such units of said
   3-27  universities and university systems nets, seines, and other marine
    4-1  equipment, which have been seized under this section, to be used in
    4-2  carrying out the teaching and research programs within said
    4-3  institutions.
    4-4        SECTION 7.  Section 2(5)(A), Chapter 421, Acts of the 63rd
    4-5  Legislature, Regular Session, 1973 (Article 6252-9b, Vernon's Texas
    4-6  Civil Statutes), is amended to read as follows:
    4-7                    (A)  "Appointed officer of a major state agency"
    4-8  means any of the following:
    4-9                          (i)  a member of the Public Utility
   4-10  Commission of Texas;
   4-11                          (ii)  a member of the Texas Department of
   4-12  Commerce;
   4-13                          (iii)  a member of the Texas Board of
   4-14  Aviation;
   4-15                          (iv)  a member of the Texas Air Control
   4-16  Board;
   4-17                          (v)  a member of the Texas Alcoholic
   4-18  Beverage Commission;
   4-19                          (vi)  a member of the Finance Commission of
   4-20  Texas;

    5-2                          (xi)  a member of the Texas Workers'
    5-3  Compensation Commission;
    5-4                          (xii)  a member of the State Board of
    5-5  Insurance;
    5-6                          (xiii)  a member of the Parks and Wildlife
    5-7  Commission;
    5-8                          (xiv)  a member of the Public Safety
    5-9  Commission;
   5-10                          (xv)  the Secretary of State;
   5-11                          (xvi)  a member of the State Securities
   5-12  Board;
   5-13                          (xvii)  a member of the Texas Amusement
   5-14  Machine Commission;
   5-15                          (xviii)  a member of the Texas Water

    9-2        SECTION 8.  (a)  The name of The University of Texas--Pan
    9-3  American is changed to The University of Texas at Edinburg.
    9-4        (b)  A reference in law to The University of Texas--Pan
    9-5  American means The University of Texas at Edinburg.
    9-6        (c)  An appropriation for the use and benefit of The
    9-7  University of Texas--Pan American is available for the use and
    9-8  benefit of The University of Texas at Edinburg.
    9-9        (d)  Before using new stationery or other supplies printed
   9-10  with the institution's name as changed by this Act, the institution
   9-11  shall use all stationery and other supplies that are printed with
   9-12  the institution's former name and are in its possession on the
   9-13  effective date of this Act.
   9-14        SECTION 9.  The importance of this legislation and the
   9-15  crowded condition of the calendars in both houses create an
   9-16  emergency and an imperative public necessity that the
   9-17  constitutional rule requiring bills to be read on three several
   9-18  days in each house be suspended, and this rule is hereby suspended,
   9-19  and that this Act take effect and be in force from and after its
   9-20  passage, and it is so enacted.
