No. 192 73R1151 KLL-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to oral health care education for personnel, inspectors, 1-3 and surveyors of long-term care facilities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter F, Chapter 242, Health and Safety 1-6 Code, is amended by adding Section 242.162 to read as follows: 1-7 Sec. 242.162. ORAL HEALTH CARE EDUCATION FOR PERSONNEL, 1-8 INSPECTORS, AND SURVEYORS. (a) The department shall develop a 1-9 comprehensive oral health care education curriculum for personnel 1-10 hired by an institution licensed under this chapter and for 1-11 inspectors and surveyors of those institutions. The department 1-12 shall distribute the curriculum to each institution and to each 1-13 local health department and public health district. 1-14 (b) An institution shall use the curriculum to provide 1-15 training to the institution's personnel concerning oral health care 1-16 and appropriate oral hygiene techniques for residents of the 1-17 institution. The training must be provided not later than the end 1-18 of the third month after the date on which an individual begins 1-19 employment with the institution. 1-20 (c) The department shall require inspectors and surveyors of 1-21 institutions to be trained using the curriculum. 1-22 (d) An inspector or surveyor conducting an inspection or 1-23 survey of an institution shall randomly review the institution's 1-24 resident records to determine if the provision of oral health care 2-1 for the residents is adequate. In addition, the inspector or 2-2 surveyor shall visually check residents during routine inspections 2-3 or surveys to confirm the level of oral health care being provided. 2-4 SECTION 2. An institution licensed under Chapter 242, Health 2-5 and Safety Code, shall provide oral health care training for 2-6 existing employees not later than the 30th day after receiving the 2-7 oral health care education curriculum developed by the Texas 2-8 Department of Health under Section 242.162, Health and Safety Code, 2-9 as added by this Act. 2-10 SECTION 3. The importance of this legislation and the 2-11 crowded condition of the calendars in both houses create an 2-12 emergency and an imperative public necessity that the 2-13 constitutional rule requiring bills to be read on three several 2-14 days in each house be suspended, and this rule is hereby suspended, 2-15 and that this Act take effect and be in force from and after its 2-16 passage, and it is so enacted.
