                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to employer's liability insurance.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter B, Chapter 5, Insurance Code, is
    1-5  amended by adding Article 5.16 to read as follows:
    1-6        Art. 5.16.  EMPLOYER'S LIABILITY INSURANCE.  (a)  Subject to
    1-7  the requirements of this subchapter, an insurer governed by this
    1-8  subchapter may issue excess employer's liability insurance and
    1-9  liability insurance covering losses arising out of the direct or
   1-10  indirect management of an employee welfare benefit plan established
   1-11  in accordance with the Employee Retirement Income Security Act of
   1-12  1974 (29 U.S.C. Sec. 1001 et seq.).
   1-13        (b)  Articles 5.14 and 5.15 of this code apply to the filing
   1-14  and approval of rates for coverage under this article.
   1-15        (c)  Notwithstanding Subsection (b) of this article, rates
   1-16  and forms for coverage under this article are governed by Article
   1-17  5.13-2 of this code.  This subsection expires December 31, 1995.
   1-18        SECTION 2.  This Act takes effect September 1, 1993, and
   1-19  applies only to an insurance policy that is delivered, issued for
   1-20  delivery, or renewed on or after January 1, 1994.  A policy that is
   1-21  delivered, issued for delivery, or renewed before January 1, 1994,
   1-22  is governed by the law as it existed immediately before the
   1-23  effective date of this Act, and that law is continued in effect for
   1-24  that purpose.
    2-1        SECTION 3.  The importance of this legislation and the
    2-2  crowded condition of the calendars in both houses create an
    2-3  emergency   and   an   imperative   public   necessity   that   the
    2-4  constitutional rule requiring bills to be read on three several
    2-5  days in each house be suspended, and this rule is hereby suspended.
