                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to residency requirements for attendance in a school
    1-3  district.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 21.031(d), Education Code, is amended to
    1-6  read as follows:
    1-7        (d)  In order for a person under the age of 18 years to
    1-8  establish a residence for the purpose of attending the public free
    1-9  schools separate and apart from his parent, guardian, or other
   1-10  person having lawful control of him under an order of a court, it
   1-11  must be established that his presence in the school district is not
   1-12  for the primary purpose of participation in extracurricular
   1-13  activities or attendance at school in the district.  The board of
   1-14  trustees shall be responsible for determining whether an applicant
   1-15  for admission is a resident of the school district for purposes of
   1-16  attending the public schools, and may adopt reasonable guidelines
   1-17  for making a determination as necessary to protect the best
   1-18  interest of students.
   1-19        SECTION 2.  This Act takes effect immediately and applies
   1-20  beginning with the 1993-1994 school year.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended,
    2-2  and that this Act take effect and be in force according to its
    2-3  terms, and it is so enacted.
