                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the performance bond for a county contract.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 262.032(b), Local Government Code, is
    1-5  amended to read as follows:
    1-6        (b)  Within 30 <10> days after the date of the signing of a
    1-7  contract or issuance of a purchase order following the acceptance
    1-8  of a bid or proposal and before beginning the work, the bidder or
    1-9  proposal offeror shall furnish a performance bond to the county, if
   1-10  required by the county, for the full amount of the contract if that
   1-11  contract exceeds $50,000.
   1-12        SECTION 2.  This Act applies only to a contract signed or a
   1-13  purchase order issued on or after the effective date of this Act.
   1-14        SECTION 3.  This Act takes effect September 1, 1993.
   1-15        SECTION 4.  The importance of this legislation and the
   1-16  crowded condition of the calendars in both houses create an
   1-17  emergency   and   an   imperative   public   necessity   that   the
   1-18  constitutional rule requiring bills to be read on three several
   1-19  days in each house be suspended, and this rule is hereby suspended.
