                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to control of litter near a landfill.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter C, Chapter 361, Health and Safety
    1-5  Code, is amended by adding Section 361.115 to read as follows:
    1-6        Sec. 361.115.  LITTER CONTROL BY SOLID WASTE LANDFILL.  The
    1-7  commission by rule shall require the owner or operator of a
    1-8  permitted solid waste landfill facility to:
    1-9              (1)  remove solid waste dumped or scattered on each
   1-10  portion of a major road or highway that is owned by the state or a
   1-11  political subdivision and that is within two miles of each entrance
   1-12  to the facility, including the corresponding right-of-way; and
   1-13              (2)  prominently display at each entrance to the
   1-14  facility a telephone number available to report solid waste dumped
   1-15  or scattered along a major road or highway leading to an entrance
   1-16  to the facility.
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
