1-20 A BILL TO BE ENTITLED
1-21 AN ACT
1-22 relating to the requirement that the assistant treasurer of a rural
1-23 fire prevention district execute and file a bond.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Section 794.036, Health and Safety Code, is
1-26 amended by adding Subsection (c) to read as follows:
1-27 (c) The commissioners court of the county in which a
1-28 single-county district is located or, if the district is located in
1-29 more than one county, the commissioners court of the county with
1-30 the largest population in the district may require that the
1-31 assistant treasurer execute and file with the county clerk of that
1-32 county a bond conditioned on the faithful execution of the
1-33 assistant treasurer's duties. The county judge of the county in
1-34 which the bond is to be filed must determine the amount and
1-35 sufficiency of the bond before it is filed.
1-36 SECTION 2. The importance of this legislation and the
1-37 crowded condition of the calendars in both houses create an
1-38 emergency and an imperative public necessity that the
1-39 constitutional rule requiring bills to be read on three several
1-40 days in each house be suspended, and this rule is hereby suspended,
1-41 and that this Act take effect and be in force from and after its
1-42 passage, and it is so enacted.
