                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the regulation of greywater.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 26.0311, Water Code, is amended to read
    1-5  as follows:
    1-6        Sec. 26.0311.  STANDARDS FOR CONTROL OF GREYWATER.  (a)  In
    1-7  this section, "greywater" means wastewater from clothes washing
    1-8  machines, showers, bathtubs, handwashing lavatories, sinks that do
    1-9  not have garbage disposal devices and that are used for food
   1-10  preparation, and sinks that are not used for <food preparation or>
   1-11  disposal of chemical and biological ingredients.
   1-12        (b)  The commission by rule shall adopt and implement minimum
   1-13  standards for the underground distribution of greywater and for the
   1-14  use of greywater in irrigation and for other agricultural,
   1-15  domestic, commercial, and industrial purposes that will assure that
   1-16  the use of greywater will not be a nuisance or damage the quality
   1-17  of surface water and groundwater in this state.
   1-18        SECTION 2.  Section 341.039, Health and Safety Code, is
   1-19  amended to read as follows:
   1-20        Sec. 341.039.  GRAYWATER STANDARDS.  (a)  The board by rule
   1-21  shall adopt and implement minimum standards for the underground
   1-22  distribution of graywater and for the use of graywater in
   1-23  irrigation and for other agricultural, domestic, commercial, and
   1-24  industrial purposes to assure that the use of graywater is not a
    2-1  nuisance and does not damage the quality of surface water and
    2-2  groundwater in this state.
    2-3        (b)  In this section, "graywater" means wastewater from
    2-4  clothes-washing machines, showers, bathtubs, hand-washing
    2-5  lavatories, sinks that do not have garbage disposal devices and
    2-6  that are used for food preparation, and sinks that are not used for
    2-7  <food preparation or> disposal of chemical and biological
    2-8  ingredients.
    2-9        SECTION 3.  The importance of this legislation and the
   2-10  crowded condition of the calendars in both houses create an
   2-11  emergency and an imperative public necessity that the
   2-12  constitutional rule requiring bills to be read on three several
   2-13  days in each house be suspended, and this rule is hereby suspended,
   2-14  and that this Act take effect and be in force from and after its
   2-15  passage, and it is so enacted.
