No. 393 By: Sibley 1-17 A BILL TO BE ENTITLED 1-18 AN ACT 1-19 relating to certain records kept by district clerks and to fees 1-20 charged for certain services performed by district or county 1-21 clerks. 1-22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-23 SECTION 1. Section 51.318, Government Code, is amended by 1-24 adding Subsection (e) to read as follows: 1-25 (e) The district clerk may not charge the United States 1-26 Immigration and Naturalization Service a fee for a copy of any 1-27 document on file or of record in the clerk's office relating to an 1-28 individual's criminal history, regardless of whether the document 1-29 is certified. 1-30 SECTION 2. Section 118.011, Local Government Code, is 1-31 amended by adding Subsection (d) to read as follows: 1-32 (d) The county clerk may not charge the United States 1-33 Immigration and Naturalization Service a fee for a copy of any 1-34 document on file or of record in the clerk's office relating to an 1-35 individual's criminal history, regardless of whether the document 1-36 is certified. 1-37 SECTION 3. Section 51.305, Government Code, is repealed. 1-38 SECTION 4. The importance of this legislation and the 1-39 crowded condition of the calendars in both houses create an 1-40 emergency and an imperative public necessity that the 1-41 constitutional rule requiring bills to be read on three several 1-42 days in each house be suspended, and this rule is hereby suspended, 1-43 and that this Act take effect and be in force from and after its 1-44 passage, and it is so enacted. 1-45 * * * * * 1-46 Austin, 1-47 Texas 1-48 May 4, 1993 1-49 Hon.
