                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to county improvement, maintenance, or repair of private
    1-3  roads used by school district vehicles.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter A, Chapter 2, County Road and Bridge
    1-6  Act (Article 6702-1, Vernon's Texas Civil Statutes), is amended by
    1-7  adding Section 2.013 to read as follows:
    1-8        Sec. 2.013.  COUNTY COOPERATION WITH LOCAL SCHOOL DISTRICT ON
    1-9  PRIVATE ROAD REPAIR.  (a)  The commissioners court of a county, in
   1-10  a declared emergency, may improve, maintain, or repair in an
   1-11  unincorporated area of the county a private road used by a school
   1-12  district to transport students to and from school in district
   1-13  vehicles.
   1-14        (b)  A declared emergency exists if the commissioners court
   1-15  of a county and the board of trustees of a school district adopt
   1-16  resolutions declaring that a failure to improve, maintain, or
   1-17  repair a private road is likely to cause an injury to a school
   1-18  district student or employee or damage to school district property
   1-19  during the transportation of students to and from the school in
   1-20  district vehicles.
   1-21        (c)  Before the commencement of the improvement, maintenance,
   1-22  or repair of a private road, the commissioners court of a county
   1-23  and the board of trustees must make a contract regarding the work
   1-24  to be performed and a reasonable charge for the work.
    2-1        SECTION 2.  The importance of this legislation and the
    2-2  crowded condition of the calendars in both houses create an
    2-3  emergency and an imperative public necessity that the
    2-4  constitutional rule requiring bills to be read on three several
    2-5  days in each house be suspended, and this rule is hereby suspended,
    2-6  and that this Act take effect and be in force from and after its
    2-7  passage, and it is so enacted.
