                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the sale of wine by the holder of a winery permit.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Sections 251.14(b), (c), (d), and (e), Alcoholic
    1-5  Beverage Code, are amended to read as follows:
    1-6        (b)  In areas where any type or classification of alcoholic
    1-7  beverages is prohibited and the issue submitted pertains to
    1-8  legalization of the sale of one or more of the prohibited types or
    1-9  classifications, the ballot shall be prepared to permit voting for
   1-10  or against one of the following issues:
   1-11              (1)  "The legal sale of beer for off-premise
   1-12  consumption only."
   1-13              (2)  "The legal sale of beer."
   1-14              (3)  "The legal sale of beer and wine for off-premise
   1-15  consumption only."
   1-16              (4)  "The legal sale of beer and wine."
   1-17              (5)  "The legal sale of all alcoholic beverages for
   1-18  off-premise consumption only."
   1-19              (6)  "The legal sale of all alcoholic beverages except
   1-20  mixed beverages."
   1-21              (7)  "The legal sale of all alcoholic beverages
   1-22  including mixed beverages."
   1-23              (8)  "The legal sale of mixed beverages."
   1-24              (9)  "The legal sale of wine on the premises of a
    2-1  holder of a winery permit for off-premise consumption only."
    2-2        (c)  In areas where the sale of all alcoholic beverages
    2-3  including mixed beverages has been legalized, the ballot shall be
    2-4  prepared to permit voting for or against one of the following
    2-5  issues in any prohibitory election:
    2-6              (1)  "The legal sale of beer for off-premise
    2-7  consumption only."
    2-8              (2)  "The legal sale of beer."
    2-9              (3)  "The legal sale of beer and wine for off-premise
   2-10  consumption only."
   2-11              (4)  "The legal sale of beer and wine."
   2-12              (5)  "The legal sale of all alcoholic beverages for
   2-13  off-premise consumption only."
   2-14              (6)  "The legal sale of all alcoholic beverages except
   2-15  mixed beverages."
   2-16              (7)  "The legal sale of all alcoholic beverages
   2-17  including mixed beverages."
   2-18              (8)  "The legal sale of mixed beverages."
   2-19              (9)  "The legal sale of wine on the premises of a
   2-20  holder of a winery permit for off-premise consumption only."
   2-21        (d)  In areas where the sale of all alcoholic beverages
   2-22  except mixed beverages has been legalized, the ballot shall be
   2-23  prepared to permit voting for or against one of the following
   2-24  issues in any prohibitory elections:
   2-25              (1)  "The legal sale of beer for off-premise
   2-26  consumption only."
   2-27              (2)  "The legal sale of beer."
    3-1              (3)  "The legal sale of beer and wine for off-premise
    3-2  consumption only."
    3-3              (4)  "The legal sale of beer and wine."
    3-4              (5)  "The legal sale of all alcoholic beverages for
    3-5  off-premise consumption only."
    3-6              (6)  "The legal sale of all alcoholic beverages except
    3-7  mixed beverages."
    3-8              (7)  "The legal sale of wine on the premises of a
    3-9  holder of a winery permit for off-premise consumption only."
   3-10        (e)  In areas where the sale of beverages containing alcohol
   3-11  not in excess of 14 percent by volume has been legalized, and those
   3-12  of higher alcoholic content are prohibited, the ballot shall be
   3-13  prepared to permit voting for or against one of the following
   3-14  issues in any prohibitory election:
   3-15              (1)  "The legal sale of beer for off-premise
   3-16  consumption only."
   3-17              (2)  "The legal sale of beer."
   3-18              (3)  "The legal sale of beer and wine for off-premise
   3-19  consumption only."
   3-20              (4)  "The legal sale of beer and wine."
   3-21              (5)  "The legal sale of wine on the premises of a
   3-22  holder of a winery permit for off-premise consumption only."
   3-23        SECTION 2.  The importance of this legislation and the
   3-24  crowded condition of the calendars in both houses create an
   3-25  emergency and an imperative public necessity that the
   3-26  constitutional rule requiring bills to be read on three several
   3-27  days in each house be suspended, and this rule is hereby suspended,
    4-1  and that this Act take effect and be in force from and after its
    4-2  passage, and it is so enacted.
