By Hochberg H.B. No. 447 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the residency of homeless individuals who register at 1-3 certain public institutions of higher education. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 54.052, Education Code, is amended by 1-6 adding Subsection (i) to read as follows: 1-7 (i) The Texas Higher Education Coordinating Board shall 1-8 adopt rules allowing a homeless individual, as defined by 42 U.S.C. 1-9 Sec. 11302, who resides in Texas for the 12-month period 1-10 immediately preceding the date of registration but who does not 1-11 have a permanent residence to be classified as a resident student 1-12 only for purposes of vocational education courses at public junior 1-13 colleges. 1-14 SECTION 2. Not later than January 1, 1994, the Texas Higher 1-15 Education Coordinating Board shall adopt initial rules as required 1-16 by Section 54.052(i), Education Code, as added by this Act. 1-17 SECTION 3. The importance of this legislation and the 1-18 crowded condition of the calendars in both houses create an 1-19 emergency and an imperative public necessity that the 1-20 constitutional rule requiring bills to be read on three several 1-21 days in each house be suspended, and this rule is hereby suspended, 1-22 and that this Act take effect and be in force from and after its 1-23 passage, and it is so enacted.
