1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the residency of homeless individuals who register at
1-22 certain public institutions of higher education.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 54.052, Education Code, is amended by
1-25 adding Subsection (i) to read as follows:
1-26 (i) The Texas Higher Education Coordinating Board shall
1-27 adopt rules allowing a homeless individual, as defined by 42 U.S.C.
1-28 Sec. 11302, who resides in Texas for the 12-month period
1-29 immediately preceding the date of registration but who does not
1-30 have a permanent residence to be classified as a resident student
1-31 only for purposes of vocational education courses at public junior
1-32 colleges.
1-33 SECTION 2. Not later than January 1, 1994, the Texas Higher
1-34 Education Coordinating Board shall adopt initial rules as required
1-35 by Section 54.052(i), Education Code, as added by this Act.
1-36 SECTION 3. The importance of this legislation and the
1-37 crowded condition of the calendars in both houses create an
1-38 emergency and an imperative public necessity that the
1-39 constitutional rule requiring bills to be read on three several
1-40 days in each house be suspended, and this rule is hereby suspended,
1-41 and that this Act take effect and be in force from and after its
1-42 passage, and it is so enacted.
