    1-1                                AN ACT
    1-2  relating to the organization and administration of judicial
    1-3  districts, to the election of district judges for the courts in
    1-4  those districts, to certain court officers and court personnel, and
    1-5  to the composition of certain juvenile boards.
    1-6        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-7        SECTION 1.  Subchapter A, Chapter 24, Government Code, is
    1-8  amended by adding Section 24.0015 to read as follows:
    1-9        Sec. 24.0015.  RESIDENCY REQUIREMENT OF JUDGES.  A district
   1-10  judge elected by place from an area that is less than the entire
   1-11  judicial district may, but need not, be a resident of the area from
   1-12  which elected.
   1-13        SECTION 2.  Subchapter B, Chapter 24, Government Code, is
   1-14  amended to read as follows:
   1-15              SUBCHAPTER B.  <CERTAIN> JUDICIAL DISTRICTS
   1-16        Sec. 24.101.  1ST JUDICIAL DISTRICT (JASPER, NEWTON, SABINE,
   1-17  SAN AUGUSTINE, SHELBY, AND TYLER COUNTIES).  (a)  The 1st Judicial
   1-18  District is composed of Jasper, Newton, Sabine, San Augustine,
   1-19  Shelby, and Tyler counties.
   1-20        (b)  The 1st Judicial District consists of three district
   1-21  courts and judges, each court numbered consecutively.
   1-22        Sec. 24.102.  2ND JUDICIAL DISTRICT (CHEROKEE COUNTY).  (a)
   1-23  The 2nd Judicial District is composed of Cherokee County.
   1-24        (b)  The 2nd Judicial District consists of one district court
    2-1  and judge.
    2-2        Sec. 24.103.  3RD JUDICIAL DISTRICT (ANDERSON AND HOUSTON
    2-3  COUNTIES).  (a)  The 3rd Judicial District is composed of Anderson
    2-4  and Houston counties.
    2-5        (b)  The 3rd Judicial District consists of two district
    2-6  courts and judges, each court numbered consecutively.
    2-7        Sec. 24.104.  4TH JUDICIAL DISTRICT (HARRISON, PANOLA, AND
    2-8  RUSK COUNTIES).  (a)  The 4th Judicial District is composed of
    2-9  Harrison, Panola, and Rusk counties.
   2-10        (b)  The 4th Judicial District consists of three district
   2-11  courts and judges, each court numbered consecutively.
   2-12        (c)  The judges for the Fourth Judicial District shall be
   2-13  elected as follows:
   2-14              (1)  The district judge for Court No. 1 shall be
   2-15  elected by the qualified voters of Harrison County.
   2-16              (2)  The district judge for Court No. 2 shall be
   2-17  elected by the qualified voters of Panola County.
   2-18              (3)  The district judge for Court No. 3 shall be
   2-19  elected by the qualified voters of Rusk County.
   2-20        Sec. 24.105.  5TH JUDICIAL DISTRICT (BOWIE AND CASS
   2-21  COUNTIES).  (a)  The 5th Judicial District is composed of Bowie and
   2-22  Cass counties.
   2-23        (b)  The 5th Judicial District consists of three district
   2-24  courts and judges, each court numbered consecutively.
   2-25        Sec. 24.106.  6TH JUDICIAL DISTRICT (DELTA, LAMAR, AND RED
   2-26  RIVER COUNTIES).  (a)  The 6th Judicial District is composed of
   2-27  Delta, Lamar, and Red River counties.
    3-1        (b)  The 6th Judicial District consists of two district
    3-2  courts and judges, each court numbered consecutively.
    3-3        Sec. 24.107.  7TH JUDICIAL DISTRICT (SMITH COUNTY).  (a)  The
    3-4  7th Judicial District is composed of Smith County.
    3-5        (b)  The 7th Judicial District consists of four district
    3-6  courts and judges, each court numbered consecutively.
    3-7        Sec. 24.108.  8TH JUDICIAL DISTRICT (FRANKLIN AND HOPKINS
    3-8  COUNTIES).  (a)  The 8th Judicial District is composed of Franklin
    3-9  and Hopkins counties.
   3-10        (b)  The 8th Judicial District consists of one district court
   3-11  and judge.
   3-12        Sec. 24.109.  9TH JUDICIAL DISTRICT (MONTGOMERY COUNTY).  (a)
   3-13  The 9th Judicial District is composed of Montgomery County.
   3-14        (b)  The 9th Judicial District consists of five district
   3-15  courts and judges, each court numbered consecutively.
   3-16        Sec. 24.110.  10TH JUDICIAL DISTRICT (GALVESTON COUNTY).  (a)
   3-17  The 10th Judicial District is composed of Galveston County.
   3-18        (b)  The 10th Judicial District consists of five district
   3-19  courts and judges, each court numbered consecutively.
   3-20        Sec. 24.111.  11TH JUDICIAL DISTRICT (HARRIS COUNTY).  (a)
   3-21  The 11th Judicial District is composed of Harris County.
   3-22        (b)  The 11th Judicial District consists of sixty-four
   3-23  district courts and judges, each court numbered consecutively.
   3-24        (c) (1)  Courts Numbered 1 through 25 shall give preference
   3-25  to criminal cases.
   3-26              (2)  The judges of Courts Numbered 1 through 25 of the
   3-27  Eleventh Judicial District shall be elected as follows:
    4-1                    (A)  The District Judge for Court Number 1 shall
    4-2  be elected by the qualified voters of State Representative District
    4-3  126.
    4-4                    (B)  The District Judge for Court Number 2 shall
    4-5  be elected by the qualified voters of State Representative District
    4-6  127.
    4-7                    (C)  The District Judge for Court Number 3 shall
    4-8  be elected by the qualified voters of State Representative District
    4-9  128.
   4-10                    (D)  The District Judge for Court Number 4 shall
   4-11  be elected by the qualified voters of State Representative District
   4-12  129.
   4-13                    (E)  The District Judge for Court Number 5 shall
   4-14  be elected by the qualified voters of State Representative District

   9-20        (e) (1)  Courts Numbered 51 through 60 shall give preference
   9-21  to family law matters.
   9-22              (2)  The judges of Courts Numbered 51 through 60 of the
   9-23  Eleventh Judicial District shall be elected as follows:
   9-24                    (A)  The District Judges for Court Numbers 51 and
   9-25  56 shall be elected by the qualified voters of State Representative
   9-26  Districts 127, 128, 139, 141, and 142.
   9-27                    (B)  The District Judges for Court Numbers 52 and
   10-1  57 shall be elected by the qualified voters of State Representative
   10-2  Districts 140, 143, 144, 145, and 148.
   10-3                    (C)  The District Judges for Court Numbers 53 and
   10-4  58 shall be elected by the qualified voters of State Representative
   10-5  Districts 129, 131, 132, 146, and 147.
   10-6                    (D)  The District Judges for Court Numbers 54 and
   10-7  59 shall be elected by the qualified voters of State Representative
   10-8  Districts 126, 130, 135, 149, and 150.
   10-9                    (E)  The District Judges for Court Numbers 55 and
  10-10  60 shall be elected by the qualified voters of State Representative
  10-11  Districts 133, 134, 136, 137, and 138.
  10-12        (e) (1)  Courts Numbered 61 through 64 shall give preference
  10-13  to juvenile law matters.
  10-14              (2)  The judges of Courts Numbered 61 through 64 of the
  10-15  Eleventh Judicial District shall be elected as follows:
  10-16                    (A)  The District Judge for Court Number 61 shall
  10-17  be elected by the qualified voters of County Commissioner Precinct
  10-18  1.
  10-19                    (B)  The District Judge for Court Number 62 shall
  10-20  be elected by the qualified voters of County Commissioner Precinct
  10-21  2.
  10-22                    (C)  The District Judge for Court Number 63 shall
  10-23  be elected by the qualified voters of County Commissioner Precinct
  10-24  3.
  10-25                    (D)  The District Judge for Court Number 64 shall
  10-26  be elected by the qualified voters of County Commissioner Precinct
  10-27  4.
   11-1        Sec. 24.112.  12TH JUDICIAL DISTRICT (LEON, MADISON, AND
   11-2  WALKER COUNTIES).  (a)  The 12th Judicial District is composed of
   11-3  Leon, Madison, and Walker counties.
   11-4        (b)  The 12th Judicial District consists of two district
   11-5  courts and judges, each court numbered consecutively.
   11-6        Sec. 24.113.  13TH JUDICIAL DISTRICT (NAVARRO COUNTY).  (a)
   11-7  The 13th Judicial District is composed of Navarro County.
   11-8        (b)  The 13th Judicial District consists of one district
   11-9  court and judge.
  11-10        Sec. 24.114.  14TH JUDICIAL DISTRICT (DALLAS COUNTY).  (a)
  11-11  The 14th Judicial District is composed of Dallas County.
  11-12        (b)  The 14th Judicial District consists of thirty-seven
  11-13  district courts and judges, each court numbered consecutively.
  11-14        Sec. 24.115.  15TH JUDICIAL DISTRICT (FANNIN AND GRAYSON
  11-15  COUNTIES).  (a)  The 15th Judicial District is composed of Fannin
  11-16  and Grayson counties.
  11-17        (b)  The 15th Judicial District consists of three district
  11-18  courts and judges, each court numbered consecutively.
  11-19        Sec. 24.116.  16TH JUDICIAL DISTRICT (DENTON COUNTY).  (a)
  11-20  The 16th Judicial District is composed of Denton County.
  11-21        (b)  The 16th Judicial District consists of six district
  11-22  courts and judges, each court numbered consecutively.
  11-23        Sec. 24.117.  17TH JUDICIAL DISTRICT (TARRANT COUNTY).  (a)
  11-24  The 17th Judicial District is composed of Tarrant County.
  11-25        (b)  The 17th Judicial District consists of twenty-five
  11-26  district courts and judges, each court numbered consecutively.
  11-27        Sec. 24.118.  18TH JUDICIAL DISTRICT (JOHNSON AND SOMERVELL
   12-1  COUNTIES).  (a)  The 18th Judicial District is composed of Johnson
   12-2  and Somervell counties.
   12-3        (b)  The 18th Judicial District consists of two district
   12-4  courts and judges, each court numbered consecutively.
   12-5        Sec. 24.119.  19TH JUDICIAL DISTRICT (McLENNAN COUNTY).  (a)
   12-6  The 19th Judicial District is composed of McLennan County.
   12-7        (b)  The 19th Judicial District consists of four district
   12-8  courts and judges, each court numbered consecutively.
   12-9        (c)  The judges for Courts Numbered 1 through 4 shall be
  12-10  elected as follows:
  12-11              (1)  The District Judge for Court Number 1 shall be
  12-12  elected by the qualified voters of County Commissioner Precinct 1.
  12-13              (2)  The District Judge for Court Number 2 shall be
  12-14  elected by the qualified voters of County Commissioner Precinct 2.
  12-15              (3)  The District Judge for Court Number 3 shall be
  12-16  elected by the qualified voters of County Commissioner Precinct 3.
  12-17              (4)  The District Judge for Court Number 4 shall be
  12-18  elected by the qualified voters of County Commissioner Precinct 4.
  12-19        Sec. 24.120.  20TH JUDICIAL DISTRICT (FALLS, MILAM, AND
  12-20  ROBERTSON COUNTIES).  (a)  The 20th Judicial District is composed
  12-21  of Falls, Milam, and Robertson counties.
  12-22        (b)  The 20th Judicial District consists of two district
  12-23  courts and judges, each court numbered consecutively.
  12-24        (c)  The District Judges for Courts Numbered 1 through 2
  12-25  shall be elected as follows:
  12-26              (1)  The District Judge for Court Number 1 shall be
  12-27  elected by the qualified voters of Falls and Robertson counties.
   13-1              (2)  The District Judge for Court Number 2 shall be
   13-2  elected by the qualified voters of Milam County.
   13-3        Sec. 24.121.  21ST JUDICIAL DISTRICT (BASTROP, BURLESON, LEE,
   13-4  AND WASHINGTON COUNTIES).  (a)  The 21st Judicial District is
   13-5  composed of Bastrop, Burleson, Lee, and Washington counties.
   13-6        (b)  The 21st Judicial District consists of of two district
   13-7  courts and judges, each court numbered consecutively.
   13-8        (c)  The judges for Courts Numbered 1 through 2 shall be
   13-9  elected as follows:
  13-10              (1)  The District Judge for Court Number 1 shall be
  13-11  elected by the qualified voters of Bastrop and Lee counties.
  13-12              (2)  The District Judge for Court Number 2 shall be
  13-13  elected by the qualified voters of Burleson and Washington
  13-14  counties.
  13-15        Sec. 24.122.  22ND JUDICIAL DISTRICT (CALDWELL AND HAYS
  13-16  COUNTIES).  (a)  The 22nd Judicial District is composed of Caldwell
  13-17  and Hays counties.
  13-18        (b)  The 22nd Judicial District consists of two district
  13-19  courts and judges, each court numbered consecutively.
  13-20        Sec. 24.123.  23RD JUDICIAL DISTRICT (MATAGORDA COUNTY).  (a)
  13-21  The 23rd Judicial District is composed of Matagorda County.
  13-22        (b)  The 23rd Judicial District consists of one district
  13-23  court and judge.
  13-24        Sec. 24.124.  24TH JUDICIAL DISTRICT (CALHOUN, DEWITT,
  13-25  GOLIAD, JACKSON, REFUGIO, AND VICTORIA COUNTIES).  (a)  The 24th
  13-26  Judicial District is composed of Calhoun, DeWitt, Goliad, Jackson,
  13-27  Refugio, and Victoria counties.
   14-1        (b)  The 24th Judicial District consists of four district
   14-2  courts and judges, each court numbered consecutively.
   14-3        Sec. 24.125.  25TH JUDICIAL DISTRICT (COLORADO, GONZALES, AND
   14-4  LAVACA COUNTIES).  (a)  The 25th Judicial District is composed of
   14-5  Colorado, Gonzales, and Lavaca counties.
   14-6        (b)  The 25th Judicial District consists of one district
   14-7  court and judge.
   14-8        Sec. 24.126.  26TH JUDICIAL DISTRICT (WILLIAMSON COUNTY).
   14-9  (a)  The 26th Judicial District is composed of Williamson County.
  14-10        (b)  The 26th Judicial District consists of three district
  14-11  courts and judges, each court numbered consecutively.
  14-12        Sec. 24.127.  27TH JUDICIAL DISTRICT (BELL AND LAMPASAS
  14-13  COUNTIES).  (a)  The 27th Judicial District is composed of Bell and
  14-14  Lampasas counties.
  14-15        (b)  The 27th Judicial District consists of four district
  14-16  courts and judges, each court numbered consecutively.
  14-17        Sec. 24.128.  28TH JUDICIAL DISTRICT (NUECES COUNTY).  (a)
  14-18  The 28th Judicial District is composed of Nueces County.
  14-19        (b)  The 28th Judicial District consists of seven district
  14-20  courts and judges, each court numbered consecutively.
  14-21        Sec. 24.129.  29TH JUDICIAL DISTRICT (PALO PINTO AND PARKER
  14-22  COUNTIES).  (a)  The 29th Judicial District is composed of Palo
  14-23  Pinto and Parker counties.
  14-24        (b)  The 29th Judicial District consists of two district
  14-25  courts and judges, each court numbered consecutively.
  14-26        (c)  The judges for Courts Numbered 1 through 2 shall be
  14-27  elected as follows:
   15-1              (1)  The District Judge for Court Number 1 shall be
   15-2  elected by the qualified voters of Parker County.
   15-3              (2)  The District Judge for Court Number 2 shall be
   15-4  elected by the qualified voters of Palo Pinto County.
   15-5        Sec. 24.130.  30TH JUDICIAL DISTRICT (WICHITA COUNTY).  (a)
   15-6  The 30th Judicial District is composed of Wichita County.
   15-7        (b)  The 30th Judicial District consists of three district
   15-8  courts and judges, each court numbered consecutively.
   15-9        Sec. 24.131.  31ST JUDICIAL DISTRICT (HEMPHILL, LIPSCOMB,
  15-10  ROBERTS, AND WHEELER COUNTIES).  (a)  The 31st Judicial District is
  15-11  composed of Hemphill, Lipscomb, Roberts, and Wheeler counties.
  15-12        (b)  The 31st Judicial District consists of one district
  15-13  court and judge.
  15-14        Sec. 24.132.  32ND JUDICIAL DISTRICT (FISHER, GLASSCOCK,
  15-15  HOWARD, MARTIN, MITCHELL, AND NOLAN COUNTIES).  (a)  The 32nd
  15-16  Judicial District is composed of Fisher, Glasscock, Howard, Martin,
  15-17  Mitchell, and Nolan counties.
  15-18        (b)  The 32nd Judicial District consists of two district
  15-19  courts and judges, each court numbered consecutively.
  15-20        (c)  The judges for Courts Numbered 1 through 2 shall be
  15-21  elected as follows:
  15-22              (1)  The District Judge for Court Number 1 shall be
  15-23  elected by the qualified voters of Glasscock, Howard, and Martin
  15-24  counties.
  15-25              (2)  The District Judge for Court Number 2 shall be
  15-26  elected by the qualified voters of Fisher, Mitchell, and Nolan
  15-27  counties.
   16-1        Sec. 24.133.  33RD JUDICIAL DISTRICT (BLANCO, BURNET, LLANO,
   16-2  MASON, AND SAN SABA COUNTIES).  (a)  The 33rd Judicial District is
   16-3  composed of Blanco, Burnet, Llano, Mason, and San Saba counties.
   16-4        (b)  The 33rd Judicial District consists of one district
   16-5  court and judge.
   16-6        Sec. 24.134.  34TH JUDICIAL DISTRICT (CULBERSON, HUDSPETH,
   16-7  REEVES, AND WARD COUNTIES).  (a)  The 34th Judicial District is
   16-8  composed of Culberson, Hudspeth, Reeves, and Ward counties.
   16-9        (b)  The 34th Judicial District consists of one district
  16-10  court and judge.
  16-11        Sec. 24.135.  35TH JUDICIAL DISTRICT (BROWN AND MILLS
  16-12  COUNTIES).  (a)  The 35th Judicial District is composed of Brown
  16-13  and Mills counties.
  16-14        (b)  The 35th Judicial District consists of one district
  16-15  court and judge.

  29-17  HAMILTON COUNTIES).  (a)  The 102nd Judicial District is composed
  29-18  of Bosque, Comanche, and Hamilton counties.
  29-19        (b)  The 102nd Judicial District consists of one district
  29-20  court and judge.
  29-21        Sec. 24.203.  103RD JUDICIAL DISTRICT (CAMERON AND WILLACY
  29-22  COUNTIES).  (a)  The 103rd Judicial District is composed of Cameron
  29-23  and Willacy counties.
  29-24        (b)  The 103rd Judicial District consists of five district
  29-25  courts and judges, each court numbered consecutively.
  29-26        Sec. 24.204.  104TH JUDICIAL DISTRICT (POLK, SAN JACINTO, AND
  29-27  TRINITY COUNTIES).  (a)  The 104th Judicial District is composed of
   30-1  Polk, San Jacinto, and Trinity counties.
   30-2        (b)  The 104th Judicial District consists of two district
   30-3  courts and judges, each court numbered consecutively.
   30-4        <Sec. 24.101.  1ST JUDICIAL DISTRICT (JASPER, NEWTON, SABINE,
   30-5  AND SAN AUGUSTINE COUNTIES).  (a)  The 1st Judicial District is
   30-6  composed of Jasper, Newton, Sabine, and San Augustine counties.>
   30-7        <(b)  In addition to other jurisdiction provided by law, the
   30-8  1st District Court in Sabine and San Augustine counties has the
   30-9  civil jurisdiction of a county court.>
  30-10        <(c)  The terms of the 1st District Court begin:>
  30-11              <(1)  in Jasper County on the first Monday in January
  30-12  and the 22nd Monday after the first Monday in January;>
  30-13              <(2)  in Newton County on the 5th and 34th Mondays
  30-14  after the first Monday in January;>
  30-15              <(3)  in San Augustine County on the 11th and 40th
  30-16  Mondays after the first Monday in January; and>
  30-17              <(4)  in Sabine County on the 17th and 45th Mondays
  30-18  after the first Monday in January.>
  30-19        <Sec. 24.102.  2ND JUDICIAL DISTRICT (CHEROKEE COUNTY).  (a)
  30-20  The 2nd Judicial District is composed of Cherokee County.>
  30-21        <(b)  The terms of the 2nd District Court begin on the first
  30-22  Mondays in March and September.>
  30-23        <(c)  The judge may take a vacation and not attend court for
  30-24  four weeks in each year.>
  30-25        <Sec. 24.103.  3RD JUDICIAL DISTRICT (ANDERSON, HENDERSON,
  30-26  AND HOUSTON COUNTIES).  (a)  The 3rd Judicial District is composed
  30-27  of Anderson, Henderson, and Houston counties.>
   31-1        <(b)  The terms of the 3rd District Court begin:>
   31-2              <(1)  in Anderson County on the first Mondays in April,
   31-3  July, and December;>
   31-4              <(2)  in Henderson County on the first Mondays in
   31-5  February, June, and September; and>
   31-6              <(3)  in Houston County on the first Mondays in March,
   31-7  August, and October.>
   31-8        <Sec. 24.104.  4TH JUDICIAL DISTRICT (RUSK COUNTY).  (a)  The
   31-9  4th Judicial District is composed of Rusk County.>
  31-10        <(b)  The terms of the 4th District Court begin on the first
  31-11  Mondays in January, March, May, July, September, and November.>
  31-12        <Sec. 24.105.  5TH JUDICIAL DISTRICT (BOWIE AND CASS
  31-13  COUNTIES).  (a)  The 5th Judicial District is composed of Bowie and
  31-14  Cass counties.>
  31-15        <(b)  In addition to other jurisdiction provided by law, each
  31-16  district court in Bowie and Cass counties has the civil and
  31-17  criminal jurisdiction of a county court.>
  31-18        <(c)  In Bowie County, the 5th Judicial District has
  31-19  concurrent jurisdiction with the 102nd Judicial District.  Either
  31-20  court, in term or in vacation, may transfer a pending civil or
  31-21  criminal case to the other court by an order entered on the minutes
  31-22  of the transferring court.>
  31-23        <(d)  The terms of the 5th District Court begin:>
  31-24              <(1)  in Bowie County on the first Mondays in January,
  31-25  April, July, and October; and>
  31-26              <(2)  in Cass County on the first Mondays in February,
  31-27  May, August, and November.>
   32-1        <(e)  The 5th and 102nd district courts may sit in Bowie
   32-2  County in Texarkana, in addition to Boston, to try, hear, and
   32-3  determine nonjury civil or criminal cases, motions, arguments, and
   32-4  other nonjury matters.>
   32-5        <(f)  When the courts sit in Texarkana, the Bowie County
   32-6  district clerk or the clerk's deputy shall serve as clerk of the
   32-7  courts and may transfer all necessary books, minutes, and records
   32-8  to Texarkana or Boston when necessary.  The Bowie County sheriff or
   32-9  the sheriff's deputy shall attend the courts in Texarkana and
  32-10  perform all duties required by law or by the court.>
  32-11        <(g)  The Commissioners Court of Bowie County may provide
  32-12  suitable quarters for the 5th and 102nd district courts in
  32-13  Texarkana or may make an agreement with the City of Texarkana to
  32-14  provide quarters.>
  32-15        <Sec. 24.106.  6TH JUDICIAL DISTRICT (FANNIN, LAMAR, AND RED
  32-16  RIVER COUNTIES).  (a)  The 6th Judicial District is composed of
  32-17  Fannin, Lamar, and Red River counties.>
  32-18        <(b)  In addition to other jurisdiction provided by law, each
  32-19  district court in Red River County has the civil and criminal
  32-20  jurisdiction of a county court.>
  32-21        <(c)  In Red River County, the 6th Judicial District has
  32-22  concurrent jurisdiction with the 102nd Judicial District.  In Lamar
  32-23  County, the 6th Judicial District has concurrent jurisdiction with
  32-24  the 62nd Judicial District.>
  32-25        <(d)  In any county in the district in which there are two or
  32-26  more district courts, the judges of those courts may, in their
  32-27  discretion, either in termtime or in vacation, on motion of any
   33-1  party, on agreement of the parties, or on their own motion,
   33-2  transfer any civil or criminal case or proceeding on their dockets
   33-3  to the docket of one of the other district courts.  In Lamar
   33-4  County, the judges may transfer a case by an order entered in the
   33-5  minutes of the transferring court.  The judges of the courts may,
   33-6  in their discretion, exchange benches or districts from time to
   33-7  time.  Any of the judges may in his own courtroom try and determine
   33-8  any case or proceeding pending in any of the other courts without
   33-9  having the case transferred or may sit in any of the other courts
  33-10  and hear and determine any case or proceeding pending in one of
  33-11  those courts.  Two or more judges may try different cases in the
  33-12  same court at the same time and each may occupy his own courtroom
  33-13  or the room of any other court.  In case of absence, sickness, or
  33-14  disqualification of any of the judges, any other of the judges may
  33-15  hold court for him.  Any of the judges may hear and determine any
  33-16  part or question of any case or proceeding pending in any of the
  33-17  courts, and any other of the judges may complete the hearing and
  33-18  render judgment in the proceeding.  Any of the judges may hear and
  33-19  determine motions, petitions for injunction, applications for
  33-20  appointment of receivers, interventions, motions to transfer venue,
  33-21  pleas in abatement and all dilatory pleas, motions for new trials,
  33-22  and all preliminary matters, questions, and proceedings, and may
  33-23  enter judgment or order on them in the court in which the case or
  33-24  proceeding is pending without having the matter transferred to the
  33-25  court of the acting judge.  The judge in whose court the matter is
  33-26  pending may proceed to hear, complete, and determine the matter or
  33-27  all or any part of any other matter and may render final judgment
   34-1  on it.  Any of the judges of the courts may issue restraining
   34-2  orders and injunctions returnable to any of the other courts.  This
   34-3  subsection does not limit the powers of the judges when acting for
   34-4  any other judge by exchange of benches or otherwise.>
   34-5        <(e)  The terms of the 6th District Court in each county in
   34-6  the district begin on the first Mondays in January and July.>
   34-7        <Sec. 24.107.  7TH JUDICIAL DISTRICT (SMITH COUNTY).  (a)
   34-8  The 7th Judicial District is composed of Smith County.>
   34-9        <(b)  The terms of the 7th District Court begin on the first
  34-10  Mondays in January and July.>
  34-11        <Sec. 24.108.  8TH JUDICIAL DISTRICT (DELTA, FRANKLIN,
  34-12  HOPKINS, AND RAINS COUNTIES).  (a)  The 8th Judicial District is
  34-13  composed of Delta, Franklin, Hopkins, and Rains counties.>
  34-14        <(b)  In any county in the district in which there are two or
  34-15  more district courts, those district courts have concurrent
  34-16  jurisdiction in that county.>
  34-17        <(c)  In any county in the district in which there are two or
  34-18  more district courts, the judges of those courts may, in their
  34-19  discretion, either in termtime or in vacation, on motion of any

  35-27  Mondays in January and July.>
   36-1        <Sec. 24.109.  9TH JUDICIAL DISTRICT (MONTGOMERY, POLK, SAN
   36-2  JACINTO, AND WALLER COUNTIES).  (a)  The 9th Judicial District is
   36-3  composed of Montgomery, Polk, San Jacinto, and Waller counties.>
   36-4        <(b)  In Polk County, the 9th Judicial District has
   36-5  concurrent jurisdiction with the county court in all misdemeanor
   36-6  cases in which the county court has jurisdiction.  Misdemeanor
   36-7  cases may be filed in either the district or county court and may
   36-8  be transferred from one court to another.  A misdemeanor case in
   36-9  which the courts have concurrent jurisdiction may not be
  36-10  transferred from one court to another without the consent of the
  36-11  judge of the court to which it is transferred.>
  36-12        <(c)  The 9th and 155th district courts have concurrent
  36-13  jurisdiction in Waller County.>
  36-14        <(d)  The terms of the 9th District Court begin:>
  36-15              <(1)  in Montgomery County on the 16th Monday after the
  36-16  first Monday in January and the 18th Monday after the first Monday
  36-17  in July;>
  36-18              <(2)  in Polk County on the first Monday in January and
  36-19  the third Monday in July;>
  36-20              <(3)  in San Jacinto County on the seventh Monday after
  36-21  the first Monday in January and the ninth Monday after the first
  36-22  Monday in July; and>
  36-23              <(4)  in Waller County on the 10th Monday after the
  36-24  first Monday in January and the 12th Monday after the first Monday
  36-25  in July.>
  36-26        <Sec. 24.110.  SECOND 9TH JUDICIAL DISTRICT (MONTGOMERY,
  36-27  POLK, SAN JACINTO, AND TRINITY COUNTIES).  (a)  The Second 9th
   37-1  Judicial District is composed of Montgomery, Polk, San Jacinto, and
   37-2  Trinity counties.>
   37-3        <(b)  In Polk County, the Second 9th Judicial District has
   37-4  concurrent jurisdiction with the county court in all misdemeanor
   37-5  cases in which the county court has jurisdiction.  Misdemeanor

  37-16              <(2)  in Polk County on the 18th Monday after the first
  37-17  Monday in January and the 20th Monday after the first Monday in
  37-18  July;>
  37-19              <(3)  in San Jacinto County on the 16th Monday after
  37-20  the first Monday in January and the 18th Monday after the first
  37-21  Monday in July; and>
  37-22              <(4)  in Trinity County on the first Monday in January
  37-23  and the 23rd Monday after the first Monday in January.>
  37-24        <Sec. 24.111.  10TH JUDICIAL DISTRICT (GALVESTON COUNTY).
  37-25  (a)  The 10th Judicial District is composed of Galveston County.>
  37-26        <(b)  The terms of the 10th and 56th district courts begin on
  37-27  the first Mondays in January and July.>
   38-1        <(c)  In all suits, actions, or proceedings in the district
   38-2  courts in Galveston County, it is sufficient for the address or
   38-3  designation to be the "District Court of Galveston County.">
   38-4        <Sec. 24.112.  11TH JUDICIAL DISTRICT (HARRIS COUNTY).  (a)
   38-5  The 11th Judicial District is composed of Harris County.>
   38-6        <(b)  The provisions of this section apply to the 11th, 55th,
   38-7  61st, 80th, 113th, 125th, 127th, 129th, 133rd, 151st, 152nd, 157th,
   38-8  164th, and 165th judicial districts.>
   38-9        <(c)  The terms of each of the district courts begin on the
  38-10  first Mondays in January and July.  The first term is designated
  38-11  the January-June term and the second term is designated the
  38-12  July-December term.>
  38-13        <(d)  In all suits, actions, or proceedings in the district
  38-14  courts, it is sufficient for the address or designation to be
  38-15  "District Court of Harris County.">
  38-16        <(e)  The judge of each district court shall sign the minutes
  38-17  of each court term not later than the 30th day after the end of the
  38-18  term and shall also sign the minutes at the end of each volume of
  38-19  the minutes.  Each judge sitting in the court shall sign the
  38-20  minutes of the proceedings that were held before him.>
  38-21        <(f)  The judge of each district court may take the same
  38-22  vacation as the other district court judges of Harris County at any
  38-23  time during the year.  During the judge's vacation, the court term
  38-24  remains open, and the judge of any other district court may hold
  38-25  court during the judge's vacation.  The practicing lawyers of the
  38-26  court may not elect a special judge as provided by Section 24.005
  38-27  because of the absence of the judge on vacation unless another
   39-1  district court judge is not in the county.  The judges of the
   39-2  district courts shall, by agreement among themselves, take their
   39-3  vacations alternately so that there are at all times at least six
   39-4  district court judges in the county.>
   39-5        <Sec. 24.113.  12TH JUDICIAL DISTRICT (GRIMES, LEON, MADISON,
   39-6  AND WALKER COUNTIES).  (a)  The 12th Judicial District is composed
   39-7  of Grimes, Leon, Madison, and Walker counties.>
   39-8        <(b)  The terms of the 12th District Court in each county of
   39-9  the district begin on the first Mondays in January and July.>
  39-10        <Sec. 24.114.  13th JUDICIAL DISTRICT (NAVARRO COUNTY).  (a)
  39-11  The 13th Judicial District is composed of Navarro County.>
  39-12        <(b)  In addition to other jurisdiction provided by law, each
  39-13  district court in Navarro County has the civil jurisdiction of a
  39-14  county court.>
  39-15        <(c)  The terms of the 13th District Court begin on the first
  39-16  Mondays in January, April, July, and October.>
  39-17        <(d)  The judge of the 13th District Court shall impanel
  39-18  grand juries at the April and October terms and at any other terms
  39-19  as ordered by the judge.>
  39-20        <Sec. 24.115.  14TH JUDICIAL DISTRICT (DALLAS COUNTY).  (a)
  39-21  The 14th Judicial District is composed of Dallas County.>
  39-22        <(b)  The terms of the 14th District Court begin on the
  39-23  second Mondays in January, April, July, and October.>
  39-24        <(c)  Except for Subsection (b), which applies only to the
  39-25  14th District Court, this section applies to the 14th, 44th, 68th,
  39-26  95th, 101st, 116th, 134th, 160th, and 162nd district courts, the
  39-27  Criminal Judicial District of Dallas County, and the Criminal
   40-1  Judicial Districts Nos. 2, 3, 4, and 5 of Dallas County.>
   40-2        <(d)  The district courts and criminal district courts having
   40-3  jurisdiction in Dallas County have concurrent jurisdiction.>
   40-4        <(e)  The judges of the district and criminal district courts
   40-5  of Dallas County shall, by agreement among themselves, take
   40-6  vacations so that there are at all times at least three judges of
   40-7  those courts in the county.>
   40-8        <(f)  During the absence of a judge of a district or criminal
   40-9  district court of Dallas County for any reason except
  40-10  disqualification, the practicing lawyers of the courts may not
  40-11  elect a special judge, as provided by law, until the lawyers have
  40-12  requested the presiding judge of the First Administrative Judicial
  40-13  Region to assign a judge to preside over the court during the
  40-14  absence.  If the presiding judge does not make an assignment within
  40-15  four days after receipt of the request, the practicing lawyers may
  40-16  elect a special judge to preside over the court as provided by
  40-17  Section 24.005.>
  40-18        <(g)  The Dallas County sheriff or the sheriff's deputy shall
  40-19  attend the courts when required by law or by the judge.>
  40-20        <Sec. 24.116.  15TH JUDICIAL DISTRICT (GRAYSON COUNTY).  (a)
  40-21  The 15th Judicial District is composed of Grayson County.>
  40-22        <(b)  The 15th and 59th judicial districts have concurrent
  40-23  jurisdiction in Grayson County.>
  40-24        <(c)  The terms of the 15th District Court begin on the first
  40-25  Mondays in January, April, July, and October.>
  40-26        <Sec. 24.117.  16TH JUDICIAL DISTRICT (DENTON COUNTY).  (a)
  40-27  The 16th Judicial District is composed of Denton County.>
   41-1        <(b)  The terms of the 16th District Court begin on the first
   41-2  Mondays in January and July of each year.>
   41-3        <Sec. 24.118.  17TH JUDICIAL DISTRICT (TARRANT COUNTY).  (a)
   41-4  The 17th Judicial District is composed of Tarrant County.>
   41-5        <(b)  The 17th, 48th, 67th, 96th, and 153rd district courts
   41-6  have concurrent jurisdiction in Tarrant County.>
   41-7        <(c)  The terms of the 17th and 96th district courts begin on
   41-8  the first Mondays in January, April, July, and October.>
   41-9        <Sec. 24.119.  18TH JUDICIAL DISTRICT (JOHNSON AND SOMERVELL
  41-10  COUNTIES).  (a)  The 18th Judicial District is composed of Johnson
  41-11  and Somervell counties.>
  41-12        <(b)  The terms of the 18th District Court in each county in
  41-13  the district begin on the first Mondays in January and July.>
  41-14        <Sec. 24.120.  19TH JUDICIAL DISTRICT (MCLENNAN COUNTY).  (a)
  41-15  The 19th Judicial District is composed of McLennan County.>
  41-16        <(b)  The 19th, 54th, 74th, and 170th district courts have
  41-17  concurrent jurisdiction in McLennan County.>
  41-18        <(c)  The terms of the 19th District Court begin on the
  41-19  second Mondays in January, March, May, July, September, and
  41-20  November.>
  41-21        <Sec. 24.121.  20TH JUDICIAL DISTRICT (MILAM COUNTY).  (a)
  41-22  The 20th Judicial District is composed of Milam County.>
  41-23        <(b)  The terms of the 20th District Court begin on the third
  41-24  Mondays in January, May, and September.>
  41-25        <Sec. 24.122.  21ST JUDICIAL DISTRICT (BASTROP, BURLESON,
  41-26  LEE, AND WASHINGTON COUNTIES).  (a)  The 21st Judicial District is
  41-27  composed of Bastrop, Burleson, Lee, and Washington counties.>
   42-1        <(b)  The terms of the 21st District Court begin:>
   42-2              <(1)  in Bastrop County on the second Tuesday in
   42-3  January and the 15th Tuesday after the first Tuesday in March;>
   42-4              <(2)  in Burleson County on the 10th Tuesdays after the
   42-5  first Tuesdays in March and September;>
   42-6              <(3)  in Lee County on the sixth Tuesdays after the
   42-7  first Tuesdays in March and September; and>
   42-8              <(4)  in Washington County on the first Tuesdays in
   42-9  March and September.>
  42-10        <Sec. 24.123.  22ND JUDICIAL DISTRICT (CALDWELL, COMAL, AND
  42-11  HAYS COUNTIES).  (a)  The 22nd Judicial District is composed of
  42-12  Caldwell, Comal, and Hays counties.>
  42-13        <(b)  In addition to other jurisdiction provided by law, each
  42-14  district court in Comal County has the civil and criminal
  42-15  jurisdiction of a county court.>
  42-16        <(c)  The terms of the 22nd District Court begin:>
  42-17              <(1)  in Caldwell County on the first Mondays in March,
  42-18  June, September, and December;>
  42-19              <(2)  in Comal County on the first Mondays in April,
  42-20  July, October, and January; and>
  42-21              <(3)  in Hays County on the first Mondays in February,
  42-22  May, August, and November.>
  42-23        <Sec. 24.124.  23RD JUDICIAL DISTRICT (BRAZORIA, MATAGORDA,
  42-24  AND WHARTON COUNTIES).  (a)  The 23rd Judicial District is composed
  42-25  of Brazoria, Matagorda, and Wharton counties.>
  42-26        <(b)  The terms of the 23rd District Court begin:>
  42-27              <(1)  in Brazoria County on the first Mondays in April
   43-1  and October, and the terms are designated the April-September and
   43-2  October-March terms;>
   43-3              <(2)  in Matagorda County on the first Mondays in June
   43-4  and December, and the terms are designated the June-November and
   43-5  December-May terms; and>
   43-6              <(3)  in Wharton County on the first Mondays in July
   43-7  and January, and the terms are designated the July-December and
   43-8  January-June terms.>
   43-9        <(c)  There is one general docket for the 23rd and 130th
  43-10  district courts in Matagorda County.  All suits and proceedings
  43-11  within the jurisdiction of the courts in Matagorda County shall be
  43-12  addressed to the district court of Matagorda County.  All
  43-13  citations, notices, restraining orders, and other process issued in
  43-14  Matagorda County by the clerk or judges of the courts are
  43-15  returnable to the district court of Matagorda County without
  43-16  reference to the court number.  On return of the process the judge
  43-17  of either court may preside over the hearing or trial.  The judges
  43-18  of the 23rd and 130th district courts in Matagorda County may hear
  43-19  and dispose of any matter on the courts' general docket without
  43-20  transferring the matter.>
  43-21        <(d)  The Matagorda County district clerk shall keep one set
  43-22  of minutes in which the clerk shall record all judgments and orders
  43-23  of the 23rd and 130th district courts in Matagorda County.  Each of
  43-24  the judges of the 23rd and 130th district courts in Matagorda
  43-25  County shall sign the minutes of each term of those courts not
  43-26  later than the 30th day after the end of each term, shall sign the
  43-27  minutes at the end of each column of the minutes, and shall sign
   44-1  the minutes of the proceedings that were held before him.>
   44-2        <(e)  Each of the judges of the 23rd and 130th district
   44-3  courts may take a vacation and not attend court for six weeks in
   44-4  each year.  The judges by agreement between themselves shall take
   44-5  their vacations alternately so that there are at all times at least
   44-6  one judge in his judicial district.>
   44-7        <(f)  There is one general docket for the 23rd and 329th
   44-8  district courts in Wharton County.  All suits and proceedings
   44-9  within the jurisdiction of the courts in Wharton County shall be
  44-10  addressed to the district court of Wharton County.  All citations,
  44-11  notices, restraining orders, and other process issued in Wharton
  44-12  County by the clerk or judges of the courts are returnable to the
  44-13  district court of Wharton County without reference to the court
  44-14  number.  On return of the process the judge of either court may
  44-15  preside over the hearing or trial.  The judges of the 23rd and
  44-16  329th district courts in Wharton County may hear and dispose of any
  44-17  matter on the courts' general docket, both civil and criminal,
  44-18  without transferring the matter.>
  44-19        <(g)  The Wharton County district clerk shall keep one set of
  44-20  minutes in which the clerk shall record all judgments and orders of
  44-21  the 23rd and 329th district courts in Wharton County.  Each of the
  44-22  judges of the 23rd and 329th district courts in Wharton County
  44-23  shall sign the minutes of each term of those courts not later than
  44-24  the 30th day after the end of each term, shall sign the minutes at

  47-13  concurrent jurisdiction in Bell County.>

  47-20        <(d)  A grand jury may not be impaneled in the district
  47-21  courts in Bell County except by special order of the presiding
  47-22  judge.>
  47-23        <(e)  By order entered on the minutes of the court, the
  47-24  presiding judge of the district courts in Bell County may in his
  47-25  discretion, either in termtime or vacation, transfer any civil or
  47-26  criminal case to any of the other district courts.  The order of
  47-27  transfer and all other orders made in the case shall be copied and
   48-1  certified by the clerk and the certified copies of the orders shall
   48-2  be filed with the papers of the transferred case.  The additional
   48-3  fees caused by the transfer shall be taxed as part of the costs of
   48-4  the suit.  When a cause is transferred, the clerk shall enter the
   48-5  cause on the docket of the court to which the transfer is made and
   48-6  the judge of that court shall try and dispose of the cause as if
   48-7  the cause had been filed in his court.  Any of the judges may in
   48-8  his own courtroom try and determine any case or proceeding pending
   48-9  in any of the other courts without having the case transferred or
  48-10  may sit in any of the other courts and hear and determine any
  48-11  pending case.  The judge hearing a transferred case shall indicate
  48-12  on the docket sheet and orders that he is sitting for that
  48-13  district.  Two or more judges may try different cases in the same
  48-14  court at the same time, and each may occupy his own courtroom or
  48-15  the room of any other court.  In case of absence, sickness, or
  48-16  disqualification, any of the other judges may hold court for him.
  48-17  All bail bonds, recognizances, or other obligations taken for the
  48-18  appearance of the defendants, parties, or witnesses in any of the
  48-19  district courts or in any inferior court in Bell County shall be
  48-20  binding on all the defendants, parties, and witnesses, and their
  48-21  sureties, in any of the courts in which the case is pending or to
  48-22  which the case is transferred.  If a case is transferred, all
  48-23  process, bonds, recognizances, and obligations extant at the time
  48-24  of transfer shall be returned to and filed in the court to which
  48-25  the case is transferred and shall be valid and binding as if
  48-26  originally issued out of that court.>
  48-27        <Sec. 24.130.  28TH JUDICIAL DISTRICT (NUECES COUNTY).  (a)
   49-1  The 28th Judicial District is composed of Nueces County.>
   49-2        <(b)  The 28th District Court has concurrent jurisdiction
   49-3  with the 94th and 117th district courts in Nueces County.>

  53-27  Each judge sitting in a court shall sign the minutes of the
   54-1  proceedings held before him.  If the clerk decides to consolidate
   54-2  the minutes, each judge may accept responsibility for the
   54-3  proceedings held before him by signing at the end of the minutes or
   54-4  at the end of the volume.>
   54-5        <(h)  All bonds taken for the appearance of defendants,
   54-6  parties, or witnesses in any district court or in any inferior
   54-7  court in Bexar County are binding on all defendants, parties, or
   54-8  witnesses, and their sureties, in any of the courts in which the
   54-9  case is pending or to which the case may be transferred.  If a case
  54-10  is transferred, all process, bonds, recognizances, and obligations
  54-11  extant at the time of transfer shall be returned and filed in the
  54-12  court to which the case is transferred and are valid and binding as
  54-13  if originally issued out of that court.>
  54-14        <(i)  The judge of each district court may take a vacation at
  54-15  any time during the year.  During a judge's vacation, the court
  54-16  term remains open, and the judge of any other district court may
  54-17  hold court during the judge's vacation.  The practicing lawyers of
  54-18  the court may not elect a special judge because of the absence of
  54-19  the judge on vacation unless a Bexar County district judge is not
  54-20  present in the county.  The judges of the district courts shall, by
  54-21  agreement among themselves, take their vacations so that there are
  54-22  district court judges in the county at all times.>
  54-23        <(j)  The Bexar County sheriff or the sheriff's deputy shall
  54-24  attend each court as required by law or by the judge.>
  54-25        <(k)  The judges of the courts that give preference to
  54-26  criminal cases may impanel special and general grand juries as
  54-27  needed or by agreement between the judges.>
   55-1        <(l)  By a majority vote, the judges of the courts that give
   55-2  preference to criminal cases may jointly appoint not more than four
   55-3  grand jury bailiffs.  The bailiffs serve at the will of the judges

 104-20        (d)  The Probate and County Court of Galveston County is
 104-21  primarily responsible for and shall give preference to probate
 104-22  cases.  <The Probate and County Court may enforce an order of the
 104-23  Family District Court for the 306th Judicial District relating to a
 104-24  family law matter.>
 104-25        SECTION 6.  Section 25.1542(h), Government Code, is amended
 104-26  to read as follows:
 104-27        (h)  The judge of a county court at law shall be paid an
  105-1  annual salary that is at least 90 percent of the total annual
  105-2  salary, including supplements other than the juvenile board
  105-3  supplement, paid a district <to the> judge in the county <of the
  105-4  99th District Court>.  The salary shall be paid out of the county
  105-5  general fund on order of the commissioners court.
  105-6        SECTION 7.  Section 25.1762(d), Government Code, is amended
  105-7  to read as follows:
  105-8        (d)  A judge of a county court at law shall be paid an annual
  105-9  salary that is at least $15,000 but not more than 90 percent of the
 105-10  total annual salary paid to a district <the> judge in the county
 105-11  <of the 145th Judicial District>.  The salary shall be paid out of
 105-12  the county treasury on orders from the commissioners court.  A
 105-13  county court at law judge is entitled to reasonable travel expenses
 105-14  and necessary office expenses, including administrative and
 105-15  clerical assistance.
 105-16        SECTION 8.  Section 25.2072(m), Government Code, is amended
 105-17  to read as follows:
 105-18        (m)  The judge of the county court and the judge of a county
 105-19  court at law may agree on a plan governing the filing, numbering,
 105-20  and docketing of cases within the concurrent jurisdiction of their
 105-21  courts and the assignment of those cases for trial.  The plan may
 105-22  provide for the centralized institution and filing of all such
 105-23  cases with one court, clerk, or coordinator designated by the plan
 105-24  and for the systemized assignment of those cases to the courts
 105-25  participating in the plan, and the provisions of the plan for the
 105-26  centralized filing and assignment of cases shall control
 105-27  notwithstanding any other provisions of this section.  If the
  106-1  judges of the county court and the county court at law are unable
  106-2  to agree on a filing, docketing, and assignment of cases plan, the
  106-3  local administrative <presiding> judge <of the 36th Judicial
  106-4  District> shall design a plan for both courts.
  106-5        SECTION 9.  Section 25.2422(g), Government Code, is amended
  106-6  to read as follows:
  106-7        (g)  The district attorney of the 28th Prosecutor <49th
  106-8  Judicial> District serves as district attorney of a county court at
  106-9  law, except that the county attorney of Webb County prosecutes all
 106-10  juvenile, child welfare, mental health, and other civil cases in
 106-11  which the state is a party.  The district clerk serves as clerk of
 106-12  a county court at law in the cases enumerated in Subsection (a)(2),
 106-13  and the county clerk serves as clerk of a county court at law in
 106-14  all other cases.  The commissioners court may employ as many deputy
 106-15  sheriffs and bailiffs as are necessary to serve the court.
 106-16        SECTION 10.  Sections 26.209(a) and (c), Government Code, are
 106-17  amended to read as follows:
 106-18        (a)  The County Court of Hill County has the general
 106-19  jurisdiction of a probate court and has concurrent original and
 106-20  appellate jurisdiction with the district court <66th District
 106-21  Court> over civil and criminal matters within the jurisdiction of
 106-22  the county court.
 106-23        (c)  The district judge <of the 66th District Court> shall
 106-24  act as presiding judge between the district and county courts and
 106-25  may assign to the county court original or appellate cases that are
 106-26  within the county court's jurisdiction.  The assignment shall be
 106-27  made by docket notation.
  107-1        SECTION 11.  Chapter 32, Government Code, is repealed.
  107-2        SECTION 12.  Chapter 43, Government Code, is amended to read
  107-3  as follows:
  107-4                   CHAPTER 43.  DISTRICT ATTORNEYS.
  107-5                   Subchapter A.  General Provisions
  107-6        Sec. 43.001.  SALARY.  (a)  The legislature shall determine
  107-7  the salary of a district attorney in its appropriations for the
  107-8  support of the judiciary.
  107-9        (b)  The commissioners court of the counties comprising the
 107-10  prosecutor district may supplement the state salary of the district
 107-11  attorney.
 107-12        Sec. 43.002.  BOND.  (a)  Before assuming the duties of the
 107-13  office, a district attorney must give a bond that:
 107-14              (1)  is payable to the governor;
 107-15              (2)  is in the sum of $5,000;
 107-16              (3)  has two or more good and sufficient sureties;
 107-17              (4)  is approved by the district judge; and
 107-18              (5)  is conditioned that the district attorney will, in
 107-19  the manner prescribed by law, faithfully pay over all money that he
 107-20  collects or that comes into his hands for the state or a county.
 107-21        (b)  Each district attorney's bond shall be deposited in the
 107-22  office of the comptroller of public accounts.
 107-23        Sec. 43.003.  FAILURE TO ATTEND COURT.  If a district
 107-24  attorney fails to attend any term of the district court of a county
 107-25  in the district, the district clerk shall certify that failure to
 107-26  the comptroller of public accounts.  Unless a satisfactory reason
 107-27  for the failure is shown to the comptroller, the district attorney
  108-1  may not receive salary for the time the district attorney failed to
  108-2  attend.
  108-3        Sec. 43.004.  EXPENSES.  (a)  A district attorney engaged in
  108-4  the discharge of official duties in a county other than the
  108-5  district attorney's county of residence is entitled to traveling
  108-6  and other necessary expenses, as provided by the Travel Regulations
  108-7  Act of 1959 (Article 68233a, Vernon's Texas Civil Statutes).
  108-8        (b)  A district attorney is entitled to receive from the
  108-9  state the actual and necessary postage, telegraph, and telephone
 108-10  expenses incurred in the discharge of official duties.
 108-11        (c)  The expenses shall be paid by the state on a sworn
 108-12  itemized account showing the expenses.
 108-13        Sec. 43.005.  EMPLOYEES.  (a)  An investigator appointed by a
 108-14  district attorney is not required to be licensed attorney.
 108-15        (b)  The district attorney may appoint assistant district
 108-16  attorneys necessary to the proper performance of the district
 108-17  attorney's duties.  Commissioners court of each county in the
 108-18  prosecutor district must approve the number of assistants and other
 108-19  employees appointed and the amount of compensation of those
 108-20  employees.
 108-21        (c)  The salaries and expenses paid by the counties
 108-22  comprising the district shall be paid in proportion to the
 108-23  population of each county, except as otherwise provided by
 108-24  Subsection (d).
 108-25        (d)  The district attorney may assign employees to a specific
 108-26  county or to specific counties of the district.  The commissioners
 108-27  court of a county to which an employee is assigned may, in its
  109-1  discretion, pay a greater share of the salary or expenses of the
  109-2  employee than the proportionate share provided by Subsection (c).
  109-3  To the extent that a commissioners court pays a greater share of an
  109-4  employee's salary or expenses than that provided by Subsection (c),
  109-5  the counties to which the employee is not assigned are relieved of
  109-6  their proportionate share of the salary or expenses.
  109-7        Sec. 43.006.  GIFTS AND GRANTS.  The commissioners court of a
  109-8  county in a prosecutor district may accept gifts and grants from an
  109-9  individual, partnership, corporation, trust, foundation,
 109-10  associations, or political subdivision to finance adequate and
 109-11  effective prosecution, crime prevention, or rehabilitation programs
 109-12  in the county or district approved and administered by the district
 109-13  attorney.
 109-14     Subchapter B.  Provisions Applicable to Specific Districts.
 109-15        Sec. 43.101.  1ST PROSECUTOR DISTRICT.  The voters of Newton,
 109-16  Sabine, and San Augustine counties elect a district attorney for
 109-17  the 1st Prosecutor District who represents the state in district
 109-18  courts in those counties.
 109-19        Sec. 43.102.  2ND PROSECUTOR DISTRICT.  The voters of
 109-20  Cherokee county elect a district attorney for the 2nd Prosecutor
 109-21  District who represents the state in district courts in those
 109-22  counties.
 109-23        Sec. 43.103.  3RD PROSECUTOR DISTRICT.  The voters of Delta,
 109-24  Franklin, Hopkins, and Rains counties elect a district attorney for
 109-25  the 3rd Prosecutor District who represents the state in district
 109-26  courts in those counties.
 109-27        Sec. 43.104.  4TH PROSECUTOR DISTRICT.  The voters of Polk
  110-1  county elect a district attorney for the 4th Prosecutor District
  110-2  who represents the state in district courts in those counties.
  110-3        Sec. 43.105.  5TH PROSECUTOR DISTRICT.  The voters of
  110-4  Montgomery and Waller counties elect a district attorney for the
  110-5  5th Prosecutor District who represents the state in district courts
  110-6  in those counties.
  110-7        Sec. 43.106.  6TH PROSECUTOR DISTRICT.  The voters of Grimes,
  110-8  Madison, and Leon counties elect a district attorney for the 6th
  110-9  Prosecutor District who represents the state in district courts in
 110-10  those counties.
 110-11        Sec. 43.107.  7TH PROSECUTOR DISTRICT.  The voters of Johnson
 110-12  and Somervell counties elect a district attorney for the 7th
 110-13  Prosecutor District who represents the state in district courts in
 110-14  those counties.
 110-15        Sec. 43.108.  8TH PROSECUTOR DISTRICT.  The voters of
 110-16  Burleson and Washington counties elect a district attorney for the
 110-17  8th Prosecutor District who represents the state in district courts
 110-18  in those counties.
 110-19        Sec. 43.109.  9TH PROSECUTOR DISTRICT.  The voters of Comal
 110-20  county elect a district attorney for the 9th Prosecutor District

 119-13        Sec. 43.171.  71st PROSECUTOR DISTRICT.  The voters of Jones
 119-14  and Shackelford counties elect a district attorney for the 71st
 119-15  Prosecutor District who represents the state in district courts in
 119-16  those counties.
 119-17        Sec. 43.172.  72nd PROSECUTOR DISTRICT.  The voters of Erath
 119-18  county elect a district attorney for the  72nd Prosecutor District
 119-19  who represents the state in district courts in those counties.
 119-20        Sec. 43.173.  73rd PROSECUTOR DISTRICT.  The voters of Fort
 119-21  Bend county elect a district attorney for the  73rd Prosecutor
 119-22  District who represents the state in district courts in those
 119-23  counties.
 119-24        Sec. 43.174.  74th PROSECUTOR DISTRICT.  The voters of Wise
 119-25  and Jack counties elect a district attorney for the  74th
 119-26  Prosecutor District who represents the state in district courts in
 119-27  those counties.
  120-1        Sec. 43.175.  75th PROSECUTOR DISTRICT.  The voters of
  120-2  Hockley and Cochran counties elect a district attorney for the
  120-3  75th Prosecutor District who represents the state in district
  120-4  courts in those counties.
  120-5        Sec. 43.176.  76th PROSECUTOR DISTRICT.  The voters of Bailey
  120-6  and Parmer counties elect a district attorney for the  76th
  120-7  Prosecutor District who represents the state in district courts in
  120-8  those counties.
  120-9        Sec. 43.177.  77th PROSECUTOR DISTRICT.  The voters of
 120-10  Maverick, Dimmitt, and Zavala counties elect a district attorney
 120-11  for the  77th Prosecutor District who represents the state in
 120-12  district courts in those counties.
 120-13        Sec. 43.178.  78th PROSECUTOR DISTRICT.  The voters of
 120-14  Houston county elect a district attorney for the  78th Prosecutor
 120-15  District who represents the state in district courts in those
 120-16  counties.
 120-17        Sec. 43.179.  79th PROSECUTOR DISTRICT.  The voters of Hood
 120-18  county elect a district attorney for the  79th Prosecutor District
 120-19  who represents the state in district courts in those counties.
 120-20        Sec. 43.180.  HARRIS COUNTY DISTRICT ATTORNEY.  (a)  The
 120-21  voters of Harris county elect a district attorney.
 120-22        (b)  The district attorney shall attend each term and session
 120-23  of the district courts of Harris County.  The district attorney
 120-24  shall represent the state in criminal cases pending in the district
 120-25  and inferior courts of the county.  The district attorney has
 120-26  control of any case heard on habeas corpus before any civil
 120-27  district court or criminal court of the county.
  121-1        (c)  The district attorney may not engage in private practice
  121-2  of law whether or not he is compensated for his services.
  121-3        SECTION 13.  Chapter 43, Government Code, is repealed.
  121-4        SECTION 14.  Section 45.130, Government Code, is repealed.
  121-5        SECTION 15.  Section 45.142(c), Government Code, is repealed.
  121-6        SECTION 16.  Section 46.002, Government Code, is amended to

  122-5        SECTION 17.  Sections 52.043, 52.052, and 52.057, Government
  122-6  Code, are repealed.
  122-7        SECTION 18.  Section 52.054, Government Code, is amended to
  122-8  read as follows:
  122-9        Sec. 52.054.  Apportionment of Salary.  The <(a)  Except as
 122-10  provided by Subsections (b) and (c), the> salary of an official
 122-11  court reporter of a judicial district that is composed of more than
 122-12  one county shall be apportioned among the counties of the district.
 122-13  Each county shall pay a portion of the salary equal to the
 122-14  proportion that its population bears to the total population of the
 122-15  judicial district.
 122-16        <(b)  The judge of the 31st Judicial District shall determine
 122-17  the proportionate amount of the salary of the official court
 122-18  reporter to be paid by each county in the district based on the
 122-19  annual case load in each county.>
 122-20        <(c)  Nueces County shall pay 50 percent of the salary of the
 122-21  official court reporter for the 105th Judicial District.  Kleberg
 122-22  and Kenedy counties shall pay the remaining 50 percent.  Kleberg
 122-23  and Kenedy counties' shares shall be equal to the proportion that
 122-24  each county's population bears to the total population of the two
 122-25  counties.>
 122-26        SECTION 19.  Chapters 53 and 54, Government Code, are
 122-27  repealed.
  123-1        SECTION 20.  Section 152.0031, Human Resources Code, is
  123-2  amended to read as follows:
  123-3        Sec. 152.0031.  APPLICATION OF SUBCHAPTER.  This subchapter
  123-4  does not apply to a county that is served by a juvenile board
  123-5  created under Subchapter <C or> D.
  123-6        SECTION 21.  Subchapter C, Chapter 152, Human Resources Code,
  123-7  is repealed.
  123-8        SECTION 22.  Sections 152.0151(c) and (d), Human Resources
  123-9  Code, are amended to read as follows:
 123-10        (c)  The commissioners courts of the counties shall pay the
 123-11  members of the juvenile board an annual salary set by the
 123-12  commissioners court at not more than $1,800, payable in equal
 123-13  monthly installments from the general fund of the counties.  The
 123-14  counties shall apportion and pay the salary according to the ratio
 123-15  used to pay the expenses of the _____ <287th> Judicial District.
 123-16        (d)  The counties shall apportion and pay the juvenile board
 123-17  costs, other than the judges' salaries, according to the ratio used
 123-18  to pay the expenses of the _____ <287th> Judicial District, unless
 123-19  the counties agree to use a different method of allocating costs.
 123-20        SECTION 23.  Sections 152.0181(a) and (g), Human Resources
 123-21  Code, are amended to read as follows:
 123-22        (a)  Baylor County is included in the _____ <50th> Judicial
 123-23  District Juvenile Board.  The juvenile board is composed of the
 123-24  judge of the _____ <50th> Judicial District and the county judge of
 123-25  each county in the judicial district.  The juvenile court judge may
 123-26  designate two public members to serve on the board without
 123-27  compensation and for a period determined by the juvenile court
  124-1  judge.
  124-2        (g)  Sections 152.0004 and 152.0005(b) do not apply to the
  124-3  _____ <50th> Judicial District Juvenile Board.
  124-4        SECTION 24.  Sections 152.0231(a) and (i), Human Resources
  124-5  Code, are amended to read as follows:
  124-6        (a)  Borden County is included in the _____ <132nd> Judicial
  124-7  District Juvenile Board.  The juvenile board is composed of the
  124-8  county judge and the district judges in Borden and Scurry counties.
  124-9        (i)  Sections 152.0002, 152.0003, 152.0004, 152.0005(a) and

 128-22        Sec. 152.2141.  Scurry County.  (a)  Scurry County is
 128-23  included in the _____ <132nd> Judicial District Juvenile Board.
 128-24        (b)  Section 152.0231 applies to the _____ <132nd> Judicial
 128-25  District Juvenile Board.
 128-26        SECTION 42.  Section 152.2401(a), Human Resources Code, is
 128-27  amended to read as follows:
  129-1        (a)  The Van Zandt County Juvenile Board is composed of the
  129-2  county judge, the criminal district attorney of Van Zandt County,
  129-3  and the judge of the _____ <294th> Judicial District.
  129-4        SECTION 43.  Section 152.2501, Human Resources Code, is
  129-5  amended to read as follows:
  129-6        Sec. 152.2501.  Wilbarger County.  (a)  Wilbarger County is
  129-7  included in the _____ <46th> Judicial District Juvenile Board.
  129-8        (b)  Section 152.0841 applies to the _____ <46th> Judicial
  129-9  District Juvenile Board.
 129-10        SECTION 44.  The initial vacancy in an office of judge of a
 129-11  judicial district created under Subchapter B, Chapter 24,
 129-12  Government Code, as amended by this Act, on creation of the office
 129-13  shall be filled by election.  An office of judge of a judicial
 129-14  district created under Subchapter B, Chapter 24, Government Code,
 129-15  as amended by this Act, exists for the purposes of the primary and
 129-16  general elections in 1994.   A vacancy after the initial vacancy is
 129-17  filled as provided by Article V, Section 28, of the Texas
 129-18  Constitution.
 129-19        SECTION 45.  (a)  Except for the purposes described by
 129-20  Section 42 of this Act, Sections 1-41 of this Act take effect
 129-21  January 1, 1995.
 129-22        (b)  Section 42 of this Act takes effect September 1, 1993.
 129-23        SECTION 46.  The importance of this legislation and the
 129-24  crowded condition of the calendars in both houses create an
 129-25  emergency   and   an   imperative   public   necessity   that   the
 129-26  constitutional rule requiring bills to be read on three several
 129-27  days in each house be suspended, and this rule is hereby suspended.
