  21-13        <(c)  In Bowie County, the 5th Judicial District has
  21-14  concurrent jurisdiction with the 102nd Judicial District.  Either
  21-15  court, in term or in vacation, may transfer a pending civil or
  21-16  criminal case to the other court by an order entered on the minutes
  21-17  of the transferring court.>
  21-18        <(d)  The terms of the 5th District Court begin:>
  21-19              <(1)  in Bowie County on the first Mondays in January,
  21-20  April, July, and October; and>
  21-21              <(2)  in Cass County on the first Mondays in February,
  21-22  May, August, and November.>
  21-23        <(e)  The 5th and 102nd district courts may sit in Bowie
  21-24  County in Texarkana, in addition to Boston, to try, hear, and
  21-25  determine nonjury civil or criminal cases, motions, arguments, and
  21-26  other nonjury matters.>
  21-27        <(f)  When the courts sit in Texarkana, the Bowie County
   22-1  district clerk or the clerk's deputy shall serve as clerk of the
   22-2  courts and may transfer all necessary books, minutes, and records
   22-3  to Texarkana or Boston when necessary.  The Bowie County sheriff or
   22-4  the sheriff's deputy shall attend the courts in Texarkana and
   22-5  perform all duties required by law or by the court.>
   22-6        <(g)  The Commissioners Court of Bowie County may provide
   22-7  suitable quarters for the 5th and 102nd district courts in
   22-8  Texarkana or may make an agreement with the City of Texarkana to
   22-9  provide quarters.>
  22-10        <Sec. 24.106.  6TH JUDICIAL DISTRICT (FANNIN, LAMAR, AND RED
  22-11  RIVER COUNTIES).  (a)  The 6th Judicial District is composed of
  22-12  Fannin, Lamar, and Red River counties.>
  22-13        <(b)  In addition to other jurisdiction provided by law, each
  22-14  district court in Red River County has the civil and criminal
  22-15  jurisdiction of a county court.>
  22-16        <(c)  In Red River County, the 6th Judicial District has
  22-17  concurrent jurisdiction with the 102nd Judicial District.  In Lamar
  22-18  County, the 6th Judicial District has concurrent jurisdiction with
  22-19  the 62nd Judicial District.>
  22-20        <(d)  In any county in the district in which there are two or
  22-21  more district courts, the judges of those courts may, in their
  22-22  discretion, either in termtime or in vacation, on motion of any
  22-23  party, on agreement of the parties, or on their own motion,
  22-24  transfer any civil or criminal case or proceeding on their dockets
  22-25  to the docket of one of the other district courts.  In Lamar
  22-26  County, the judges may transfer a case by an order entered in the
  22-27  minutes of the transferring court.  The judges of the courts may,
   23-1  in their discretion, exchange benches or districts from time to
   23-2  time.  Any of the judges may in his own courtroom try and determine
   23-3  any case or proceeding pending in any of the other courts without
   23-4  having the case transferred or may sit in any of the other courts
   23-5  and hear and determine any case or proceeding pending in one of
   23-6  those courts.  Two or more judges may try different cases in the
   23-7  same court at the same time and each may occupy his own courtroom
   23-8  or the room of any other court.  In case of absence, sickness, or
   23-9  disqualification of any of the judges, any other of the judges may
  23-10  hold court for him.  Any of the judges may hear and determine any
  23-11  part or question of any case or proceeding pending in any of the
  23-12  courts, and any other of the judges may complete the hearing and
  23-13  render judgment in the proceeding.  Any of the judges may hear and
  23-14  determine motions, petitions for injunction, applications for
  23-15  appointment of receivers, interventions, motions to transfer venue,
  23-16  pleas in abatement and all dilatory pleas, motions for new trials,
  23-17  and all preliminary matters, questions, and proceedings, and may
  23-18  enter judgment or order on them in the court in which the case or
  23-19  proceeding is pending without having the matter transferred to the
  23-20  court of the acting judge.  The judge in whose court the matter is
  23-21  pending may proceed to hear, complete, and determine the matter or
  23-22  all or any part of any other matter and may render final judgment
  23-23  on it.  Any of the judges of the courts may issue restraining
  23-24  orders and injunctions returnable to any of the other courts.  This
  23-25  subsection does not limit the powers of the judges when acting for
  23-26  any other judge by exchange of benches or otherwise.>
  23-27        <(e)  The terms of the 6th District Court in each county in
   24-1  the district begin on the first Mondays in January and July.>
   24-2        <Sec. 24.107.  7TH JUDICIAL DISTRICT (SMITH COUNTY).  (a)
   24-3  The 7th Judicial District is composed of Smith County.>
   24-4        <(b)  The terms of the 7th District Court begin on the first
   24-5  Mondays in January and July.>
   24-6        <Sec. 24.108.  8TH JUDICIAL DISTRICT (DELTA, FRANKLIN,
   24-7  HOPKINS, AND RAINS COUNTIES).  (a)  The 8th Judicial District is
   24-8  composed of Delta, Franklin, Hopkins, and Rains counties.>
   24-9        <(b)  In any county in the district in which there are two or
  24-10  more district courts, those district courts have concurrent
  24-11  jurisdiction in that county.>
  24-12        <(c)  In any county in the district in which there are two or
  24-13  more district courts, the judges of those courts may, in their

  25-24  JACINTO, AND WALLER COUNTIES).  (a)  The 9th Judicial District is
  25-25  composed of Montgomery, Polk, San Jacinto, and Waller counties.>
  25-26        <(b)  In Polk County, the 9th Judicial District has
  25-27  concurrent jurisdiction with the county court in all misdemeanor
   26-1  cases in which the county court has jurisdiction.  Misdemeanor
   26-2  cases may be filed in either the district or county court and may
   26-3  be transferred from one court to another.  A misdemeanor case in
   26-4  which the courts have concurrent jurisdiction may not be
   26-5  transferred from one court to another without the consent of the

   26-7        <(c)  The 9th and 155th district courts have concurrent

  27-26        <Sec. 24.112.  11TH JUDICIAL DISTRICT (HARRIS COUNTY).  (a)
  27-27  The 11th Judicial District is composed of Harris County.>
   28-1        <(b)  The provisions of this section apply to the 11th, 55th,
   28-2  61st, 80th, 113th, 125th, 127th, 129th, 133rd, 151st, 152nd, 157th,
   28-3  164th, and 165th judicial districts.>
   28-4        <(c)  The terms of each of the district courts begin on the
   28-5  first Mondays in January and July.  The first term is designated
   28-6  the January-June term and the second term is designated the
   28-7  July-December term.>
   28-8        <(d)  In all suits, actions, or proceedings in the district
   28-9  courts, it is sufficient for the address or designation to be
  28-10  "District Court of Harris County.">
  28-11        <(e)  The judge of each district court shall sign the minutes
  28-12  of each court term not later than the 30th day after the end of the
  28-13  term and shall also sign the minutes at the end of each volume of
  28-14  the minutes.  Each judge sitting in the court shall sign the
  28-15  minutes of the proceedings that were held before him.>
  28-16        <(f)  The judge of each district court may take the same
  28-17  vacation as the other district court judges of Harris County at any
  28-18  time during the year.  During the judge's vacation, the court term
  28-19  remains open, and the judge of any other district court may hold
  28-20  court during the judge's vacation.  The practicing lawyers of the
  28-21  court may not elect a special judge as provided by Section 24.005
  28-22  because of the absence of the judge on vacation unless another
  28-23  district court judge is not in the county.  The judges of the
  28-24  district courts shall, by agreement among themselves, take their
  28-25  vacations alternately so that there are at all times at least six
  28-26  district court judges in the county.>
  28-27        <Sec. 24.113.  12TH JUDICIAL DISTRICT (GRIMES, LEON, MADISON,
   29-1  AND WALKER COUNTIES).  (a)  The 12th Judicial District is composed
   29-2  of Grimes, Leon, Madison, and Walker counties.>

  29-24        <(d)  The district courts and criminal district courts having
  29-25  jurisdiction in Dallas County have concurrent jurisdiction.>
  29-26        <(e)  The judges of the district and criminal district courts
  29-27  of Dallas County shall, by agreement among themselves, take
   30-1  vacations so that there are at all times at least three judges of
   30-2  those courts in the county.>
   30-3        <(f)  During the absence of a judge of a district or criminal
   30-4  district court of Dallas County for any reason except
   30-5  disqualification, the practicing lawyers of the courts may not
   30-6  elect a special judge, as provided by law, until the lawyers have
   30-7  requested the presiding judge of the First Administrative Judicial
   30-8  Region to assign a judge to preside over the court during the
   30-9  absence.  If the presiding judge does not make an assignment within
  30-10  four days after receipt of the request, the practicing lawyers may

  32-20  of Brazoria, Matagorda, and Wharton counties.>
  32-21        <(b)  The terms of the 23rd District Court begin:>
  32-22              <(1)  in Brazoria County on the first Mondays in April

   33-4        <(c)  There is one general docket for the 23rd and 130th
   33-5  district courts in Matagorda County.  All suits and proceedings
   33-6  within the jurisdiction of the courts in Matagorda County shall be
   33-7  addressed to the district court of Matagorda County.  All
   33-8  citations, notices, restraining orders, and other process issued in
   33-9  Matagorda County by the clerk or judges of the courts are
  33-10  returnable to the district court of Matagorda County without
  33-11  reference to the court number.  On return of the process the judge
  33-12  of either court may preside over the hearing or trial.  The judges
  33-13  of the 23rd and 130th district courts in Matagorda County may hear
  33-14  and dispose of any matter on the courts' general docket without
  33-15  transferring the matter.>
  33-16        <(d)  The Matagorda County district clerk shall keep one set
  33-17  of minutes in which the clerk shall record all judgments and orders
  33-18  of the 23rd and 130th district courts in Matagorda County.  Each of
  33-19  the judges of the 23rd and 130th district courts in Matagorda
  33-20  County shall sign the minutes of each term of those courts not
  33-21  later than the 30th day after the end of each term, shall sign the
  33-22  minutes at the end of each column of the minutes, and shall sign
  33-23  the minutes of the proceedings that were held before him.>
  33-24        <(e)  Each of the judges of the 23rd and 130th district
  33-25  courts may take a vacation and not attend court for six weeks in
  33-26  each year.  The judges by agreement between themselves shall take
  33-27  their vacations alternately so that there are at all times at least
   34-1  one judge in his judicial district.>
   34-2        <(f)  There is one general docket for the 23rd and 329th
   34-3  district courts in Wharton County.  All suits and proceedings
   34-4  within the jurisdiction of the courts in Wharton County shall be
   34-5  addressed to the district court of Wharton County.  All citations,
   34-6  notices, restraining orders, and other process issued in Wharton
   34-7  County by the clerk or judges of the courts are returnable to the

  34-22        <Sec. 24.125.  24TH JUDICIAL DISTRICT (CALHOUN, DEWITT,
  34-23  GOLIAD, JACKSON, REFUGIO, AND VICTORIA COUNTIES).  (a)  The 24th
  34-24  Judicial District is composed of Calhoun, DeWitt, Goliad, Jackson,
  34-25  Refugio, and Victoria counties.>
  34-26        <(b)  The terms of the 24th District Court begin:>
  34-27              <(1)  in Calhoun County on the fourth Mondays in April
   35-1  and October;>

   36-3  entered on the docket of the court from which the matter was
   36-4  transferred.  A case may not be transferred without the permission
   36-5  of the judge of the court to which the case is to be transferred.>
   36-6        <Sec. 24.127.  SECOND 25TH JUDICIAL DISTRICT (COLORADO,

  36-22        <Sec. 24.128.  26TH JUDICIAL DISTRICT (WILLIAMSON COUNTY).
  36-23  (a)  The 26th Judicial District is composed of Williamson County.>
  36-24        <(b)  The terms of the 26th District Court begin on the first
  36-25  Mondays in January, March, May, July, September, and November.>
  36-26        <(c)  The judge of the 26th District Court shall organize and
  36-27  impanel grand juries for Williamson County at the March and
   37-1  September terms of the court.  When the judge considers it
   37-2  necessary, the judge, by entering an order, may organize and
   37-3  impanel grand juries at any other term of the court.>
   37-4        <Sec. 24.129.  27TH JUDICIAL DISTRICT (BELL AND LAMPASAS
   37-5  COUNTIES).  (a)  The 27th Judicial District is composed of Bell and
   37-6  Lampasas counties.>
   37-7        <(b)  The 27th, 146th, and 169th judicial districts have
   37-8  concurrent jurisdiction in Bell County.>
   37-9        <(c)  The terms of the 27th District Court begin:>
  37-10              <(1)  in Bell County on the first Mondays in January,
  37-11  April, July, and October; and>
  37-12              <(2)  in Lampasas County on the first Mondays in March
  37-13  and September and may continue in session until the Saturday night
  37-14  before the Monday on which the next session convenes.>
  37-15        <(d)  A grand jury may not be impaneled in the district
  37-16  courts in Bell County except by special order of the presiding
  37-17  judge.>
  37-18        <(e)  By order entered on the minutes of the court, the
  37-19  presiding judge of the district courts in Bell County may in his
  37-20  discretion, either in termtime or vacation, transfer any civil or
  37-21  criminal case to any of the other district courts.  The order of
  37-22  transfer and all other orders made in the case shall be copied and
  37-23  certified by the clerk and the certified copies of the orders shall
  37-24  be filed with the papers of the transferred case.  The additional
  37-25  fees caused by the transfer shall be taxed as part of the costs of
  37-26  the suit.  When a cause is transferred, the clerk shall enter the
  37-27  cause on the docket of the court to which the transfer is made and
   38-1  the judge of that court shall try and dispose of the cause as if
   38-2  the cause had been filed in his court.  Any of the judges may in
   38-3  his own courtroom try and determine any case or proceeding pending
   38-4  in any of the other courts without having the case transferred or
   38-5  may sit in any of the other courts and hear and determine any
   38-6  pending case.  The judge hearing a transferred case shall indicate
   38-7  on the docket sheet and orders that he is sitting for that
   38-8  district.  Two or more judges may try different cases in the same
   38-9  court at the same time, and each may occupy his own courtroom or
  38-10  the room of any other court.  In case of absence, sickness, or
  38-11  disqualification, any of the other judges may hold court for him.
  38-12  All bail bonds, recognizances, or other obligations taken for the
  38-13  appearance of the defendants, parties, or witnesses in any of the
  38-14  district courts or in any inferior court in Bell County shall be
  38-15  binding on all the defendants, parties, and witnesses, and their
  38-16  sureties, in any of the courts in which the case is pending or to
  38-17  which the case is transferred.  If a case is transferred, all
  38-18  process, bonds, recognizances, and obligations extant at the time
  38-19  of transfer shall be returned to and filed in the court to which
  38-20  the case is transferred and shall be valid and binding as if
  38-21  originally issued out of that court.>
  38-22        <Sec. 24.130.  28TH JUDICIAL DISTRICT (NUECES COUNTY).  (a)
  38-23  The 28th Judicial District is composed of Nueces County.>
  38-24        <(b)  The 28th District Court has concurrent jurisdiction
  38-25  with the 94th and 117th district courts in Nueces County.>
  38-26        <(c)  The terms of the 28th District Court begin on the first
  38-27  Mondays in January and July.  The terms are designated the
   39-1  January-July and July-January terms.>
   39-2        <Sec. 24.131.  29TH JUDICIAL DISTRICT (PALO PINTO COUNTY).
   39-3  (a)  The 29th Judicial District is composed of Palo Pinto County.>

  42-23        <Sec. 24.139.  ><37th Judicial District (Bexar County)><.  (a)
  42-24  The 37th Judicial District is composed of Bexar County.>
  42-25        <(b)  This section applies to the 37th, 45th, 57th, 73rd,
  42-26  131st, 144th, 150th, 166th, 175th, 186th, 187th, 224th, 225th,
  42-27  226th, 227th, 285th, 288th, 289th, and 290th district courts in
   43-1  Bexar County.>
   43-2        <(c)  The district courts in Bexar County have concurrent
   43-3  jurisdiction.>
   43-4        <(d)  The 144th, 175th, 186th, 187th, 226th, 227th, 289th,
   43-5  and 290th district courts shall give preference to criminal cases.
   43-6  The terms of those courts begin on the first Mondays in January,
   43-7  March, May, July, September, and November.  Each term continues
   43-8  until the court has disposed of the business for that term.>
   43-9        <(e)  The terms of the 37th, 45th, 57th, 73rd, 131st, 150th,
  43-10  166th, 224th, 225th, 285th, and 288th district courts begin on the
  43-11  first Mondays in January and July.>
  43-12        <(f)  The district clerk shall docket successively on the
  43-13  dockets of the courts that do not give preference to criminal cases
  43-14  all civil cases and proceedings so that the civil cases and
  43-15  proceedings are docketed in rotation and equally distributed among
  43-16  the courts.>
  43-17        <(g)  The district clerk may consolidate the minutes of the
  43-18  district courts.  If the clerk decides not to consolidate the
  43-19  minutes, the judge of each district court shall sign the minutes of
  43-20  each court term not later than the 30th day after the end of the
  43-21  term and shall also sign at the end of each volume of the minutes.
  43-22  Each judge sitting in a court shall sign the minutes of the
  43-23  proceedings held before him.  If the clerk decides to consolidate
  43-24  the minutes, each judge may accept responsibility for the
  43-25  proceedings held before him by signing at the end of the minutes or
  43-26  at the end of the volume.>
  43-27        <(h)  All bonds taken for the appearance of defendants,
   44-1  parties, or witnesses in any district court or in any inferior
   44-2  court in Bexar County are binding on all defendants, parties, or
   44-3  witnesses, and their sureties, in any of the courts in which the
   44-4  case is pending or to which the case may be transferred.  If a case
   44-5  is transferred, all process, bonds, recognizances, and obligations
   44-6  extant at the time of transfer shall be returned and filed in the
   44-7  court to which the case is transferred and are valid and binding as
   44-8  if originally issued out of that court.>
   44-9        <(i)  The judge of each district court may take a vacation at
  44-10  any time during the year.  During a judge's vacation, the court
  44-11  term remains open, and the judge of any other district court may
  44-12  hold court during the judge's vacation.  The practicing lawyers of
  44-13  the court may not elect a special judge because of the absence of
  44-14  the judge on vacation unless a Bexar County district judge is not
  44-15  present in the county.  The judges of the district courts shall, by
  44-16  agreement among themselves, take their vacations so that there are
  44-17  district court judges in the county at all times.>
  44-18        <(j)  The Bexar County sheriff or the sheriff's deputy shall
  44-19  attend each court as required by law or by the judge.>
  44-20        <(k)  The judges of the courts that give preference to
  44-21  criminal cases may impanel special and general grand juries as
  44-22  needed or by agreement between the judges.>
  44-23        <(l)  By a majority vote, the judges of the courts that give
  44-24  preference to criminal cases may jointly appoint not more than four
  44-25  grand jury bailiffs.  The bailiffs serve at the will of the judges

  62-10        <(f)  The judges of the 77th and 87th judicial districts may,
  62-11  in their discretion, either in termtime or in vacation, on motion
  62-12  of any party, on agreement of the parties, or on their own motion
  62-13  to facilitate the administration of justice or to equalize the case
  62-14  load, transfer any civil or criminal cause on their dockets to the
  62-15  docket of the other court.  The transfer shall be entered on the
  62-16  minutes of the court and the cause shall be tried and disposed of
  62-17  as if it had been originally filed in that court.  The transferring
  62-18  court need not hold a formal proceeding to transfer a cause.  The
  62-19  receiving court need not receive the transcript of the transferred
  62-20  cause to have jurisdiction over the cause.>

  94-13        SECTION 4.  Section 25.0862(d), Government Code, is amended
  94-14  to read as follows:
  94-15        (d)  The Probate and County Court of Galveston County is
  94-16  primarily responsible for and shall give preference to probate
  94-17  cases.  <The Probate and County Court may enforce an order of the
  94-18  Family District Court for the 306th Judicial District relating to a
  94-19  family law matter.>
  94-20        SECTION 5.  Section 25.1542(h), Government Code, is amended
  94-21  to read as follows:
  94-22        (h)  The judge of a county court at law shall be paid an
  94-23  annual salary that is at least 90 percent of the total annual
  94-24  salary, including supplements other than the juvenile board
  94-25  supplement, paid a district <to the> judge in the county <of the
  94-26  99th District Court>.  The salary shall be paid out of the county
  94-27  general fund on order of the commissioners court.
   95-1        SECTION 6.  Section 25.1762(d), Government Code, is amended
   95-2  to read as follows:
   95-3        (d)  A judge of a county court at law shall be paid an annual
   95-4  salary that is at least $15,000 but not more than 90 percent of the
   95-5  total annual salary paid to a district <the> judge in the county
   95-6  <of the 145th Judicial District>.  The salary shall be paid out of
   95-7  the county treasury on orders from the commissioners court.  A
   95-8  county court at law judge is entitled to reasonable travel expenses
   95-9  and necessary office expenses, including administrative and
  95-10  clerical assistance.
  95-11        SECTION 7.  Section 25.2072(m), Government Code, is amended
  95-12  to read as follows:
  95-13        (m)  The judge of the county court and the judge of a county
  95-14  court at law may agree on a plan governing the filing, numbering,
  95-15  and docketing of cases within the concurrent jurisdiction of their
  95-16  courts and the assignment of those cases for trial.  The plan may
  95-17  provide for the centralized institution and filing of all such
  95-18  cases with one court, clerk, or coordinator designated by the plan
  95-19  and for the systemized assignment of those cases to the courts
  95-20  participating in the plan, and the provisions of the plan for the
  95-21  centralized filing and assignment of cases shall control
  95-22  notwithstanding any other provisions of this section.  If the
  95-23  judges of the county court and the county court at law are unable
  95-24  to agree on a filing, docketing, and assignment of cases plan, the
  95-25  local administrative <presiding> judge <of the 36th Judicial
  95-26  District> shall design a plan for both courts.
  95-27        SECTION 8.  Section 25.2422(g), Government Code, is amended
   96-1  to read as follows:
   96-2        (g)  <The district attorney of the 49th Judicial District
   96-3  serves as district attorney of a county court at law, except that
   96-4  the county attorney of Webb County prosecutes all juvenile, child
   96-5  welfare, mental health, and other civil cases in which the state is
   96-6  a party.>  The district clerk serves as clerk of a county court at
   96-7  law in the cases enumerated in Subsection (a)(2), and the county
   96-8  clerk serves as clerk of a county court at law in all other cases.
   96-9  The commissioners court may employ as many deputy sheriffs and
  96-10  bailiffs as are necessary to serve the court.
  96-11        SECTION 9.  Sections 26.209(a) and (c), Government Code, are
  96-12  amended to read as follows:
  96-13        (a)  The County Court of Hill County has the general
  96-14  jurisdiction of a probate court and has concurrent original and
  96-15  appellate jurisdiction with the district court <66th District
  96-16  Court> over civil and criminal matters within the jurisdiction of
  96-17  the county court.
  96-18        (c)  The district judge <of the 66th District Court> shall
  96-19  act as presiding judge between the district and county courts and
  96-20  may assign to the county court original or appellate cases that are
  96-21  within the county court's jurisdiction.  The assignment shall be
  96-22  made by docket notation.
  96-23        SECTION 10.  Chapter 32, Government Code, is repealed.
  96-24        SECTION 11.  Chapter 43, Government Code, is repealed.
  96-25        SECTION 12.  Section 45.130, Government Code, is repealed.
  96-26        SECTION 13.  Section 45.142(c), Government Code, is repealed.
  96-27        SECTION 14.  Section 46.002, Government Code, is repealed.
   97-1        SECTION 15.  Sections 52.043, 52.052, and 52.057, Government
   97-2  Code, are repealed.
   97-3        SECTION 16.  Section 52.054, Government Code, is amended to
   97-4  read as follows:
   97-5        Sec. 52.054.  Apportionment of Salary.  The <(a)  Except as
   97-6  provided by Subsections (b) and (c), the> salary of an official
   97-7  court reporter of a judicial district that is composed of more than
   97-8  one county shall be apportioned among the counties of the district.
   97-9  Each county shall pay a portion of the salary equal to the
  97-10  proportion that its population bears to the total population of the
  97-11  judicial district.
  97-12        <(b)  The judge of the 31st Judicial District shall determine
  97-13  the proportionate amount of the salary of the official court
  97-14  reporter to be paid by each county in the district based on the
  97-15  annual case load in each county.>
  97-16        <(c)  Nueces County shall pay 50 percent of the salary of the
  97-17  official court reporter for the 105th Judicial District.  Kleberg
  97-18  and Kenedy counties shall pay the remaining 50 percent.  Kleberg
  97-19  and Kenedy counties' shares shall be equal to the proportion that
  97-20  each county's population bears to the total population of the two
  97-21  counties.>
  97-22        SECTION 17.  Chapters 53 and 54, Government Code, are
  97-23  repealed.
  97-24        SECTION 18.  Section 152.0031, Human Resources Code, is
  97-25  amended to read as follows:
  97-26        Sec. 152.0031.  APPLICATION OF SUBCHAPTER.  This subchapter
  97-27  does not apply to a county that is served by a juvenile board
   98-1  created under Subchapter <C or> D.
   98-2        SECTION 19.  Subchapter C, Chapter 152, Human Resources Code,
   98-3  is repealed.
   98-4        SECTION 20.  Sections 152.0151(c) and (d), Human Resources
   98-5  Code, are amended to read as follows:
   98-6        (c)  The commissioners courts of the counties shall pay the
   98-7  members of the juvenile board an annual salary set by the
   98-8  commissioners court at not more than $1,800, payable in equal
   98-9  monthly installments from the general fund of the counties.  The
  98-10  counties shall apportion and pay the salary according to the ratio
  98-11  used to pay the expenses of the _____ <287th> Judicial District.
  98-12        (d)  The counties shall apportion and pay the juvenile board
  98-13  costs, other than the judges' salaries, according to the ratio used
  98-14  to pay the expenses of the _____ <287th> Judicial District, unless
  98-15  the counties agree to use a different method of allocating costs.
  98-16        SECTION 21.  Sections 152.0181(a) and (g), Human Resources
  98-17  Code, are amended to read as follows:
  98-18        (a)  Baylor County is included in the _____ <50th> Judicial
  98-19  District Juvenile Board.  The juvenile board is composed of the
  98-20  judge of the _____ <50th> Judicial District and the county judge of
  98-21  each county in the judicial district.  The juvenile court judge may
  98-22  designate two public members to serve on the board without
  98-23  compensation and for a period determined by the juvenile court
  98-24  judge.
  98-25        (g)  Sections 152.0004 and 152.0005(b) do not apply to the
  98-26  _____ <50th> Judicial District Juvenile Board.
  98-27        SECTION 22.  Sections 152.0231(a) and (i), Human Resources
   99-1  Code, are amended to read as follows:
   99-2        (a)  Borden County is included in the _____ <132nd> Judicial
   99-3  District Juvenile Board.  The juvenile board is composed of the
   99-4  county judge and the district judges in Borden and Scurry counties.
   99-5        (i)  Sections 152.0002, 152.0003, 152.0004, 152.0005(a) and
   99-6  (b), 152.0006, and 152.0008(a) do not apply to the _____ <132nd>
   99-7  Judicial District Juvenile Board.
   99-8        SECTION 23.  Sections 152.0291(a) and (h), Human Resources
   99-9  Code, are amended to read as follows:
  99-10        (a)  Briscoe County is included in the _____ <110th> Judicial
  99-11  District Juvenile Board.  The juvenile board is composed of the

  99-18        SECTION 24.  Section 152.0521(a), Human Resources Code, is
  99-19  amended to read as follows:
  99-20        (a)  The Comal County Juvenile Board is composed of the
  99-21  county judge and the judge of the _____ <207th> District Court.
  99-22        SECTION 25.  Sections 152.0571 and 152.0691, Human Resources
  99-23  Code, are amended to read as follows:
  99-24        Sec. 152.0571.  COTTLE COUNTY.  (a)  Cottle County is
  99-25  included in the _____ <50th> Judicial District Juvenile Board.

  104-6        SECTION 42.  The initial vacancy in an office of judge of a
  104-7  judicial district created under Subchapter B, Chapter 24,
  104-8  Government Code, as amended by this Act, on creation of the office
  104-9  shall be filled by election.  An office of judge of a judicial
 104-10  district created under Subchapter B, Chapter 24, Government Code,
 104-11  as amended by this Act, exists for the purposes of the primary and
 104-12  general elections in 1994.   A vacancy after the initial vacancy is
 104-13  filled as provided by Article V, Section 28, of the Texas
 104-14  Constitution.
 104-15        SECTION 43.  (a)  Except for the purposes described by
 104-16  Section 42 of this Act, Sections 1-41 of this Act take effect
 104-17  January 1, 1995.
 104-18        (b)  Section 42 of this Act takes effect September 1, 1993.
 104-19        SECTION 44.  The importance of this legislation and the
 104-20  crowded condition of the calendars in both houses create an
 104-21  emergency   and   an   imperative   public   necessity   that   the
 104-22  constitutional rule requiring bills to be read on three several
 104-23  days in each house be suspended, and this rule is hereby suspended.
