1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to use of child passenger restraints in a motor vehicle.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Sections 107B(b) and (c), Uniform Act Regulating
1-26 Traffic on Highways (Article 6701d, Vernon's Texas Civil Statutes),
1-27 are amended to read as follows:
1-28 (b) A person commits an offense if the person:
1-29 (1) <is a resident of this state;>
1-30 <(2)> transports a child younger than two years of age
1-31 by operating a passenger car or light truck on a road, street, or
1-32 highway of this state; and
1-33 (2) <(3)> does not keep the child secured during the
1-34 operation of the vehicle in a child passenger safety seat system
1-35 according to the instructions of the manufacturer of the safety
1-36 seat system.
1-37 (c) A person commits an offense if the person:
1-38 (1) <is a resident of this state;>
1-39 <(2)> transports a child who is two years of age or
1-40 older and under four years of age by operating a passenger car or
1-41 light truck on a road, street, or highway of this state; and
1-42 (2) <(3)> does not keep the child secured during the
1-43 operation of the vehicle in a child passenger safety seat system
1-44 according to the instructions of the manufacturer of the safety
1-45 seat system or by a safety belt.
1-46 SECTION 2. (a) The changes in law made by this Act apply
1-47 only to an offense committed on or after the effective date of this
1-48 Act. For purposes of this section, an offense was committed before
1-49 the effective date of this Act if any element of the offense
1-50 occurred before that date.
1-51 (b) An offense committed before the effective date of this
1-52 Act is covered by the law in effect when the offense was committed,
1-53 and the former law is continued in effect for this purpose.
1-54 SECTION 3. This Act takes effect September 1, 1993.
1-55 SECTION 4. The importance of this legislation and the
1-56 crowded condition of the calendars in both houses create an
1-57 emergency and an imperative public necessity that the
1-58 constitutional rule requiring bills to be read on three several
1-59 days in each house be suspended, and this rule is hereby suspended.
