1-21 A BILL TO BE ENTITLED
1-22 AN ACT
1-23 relating to the juvenile board of Bexar County.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Section 152.0211, Human Resources Code, is
1-26 amended to read as follows:
1-27 Sec. 152.0211. Bexar County. (a) The juvenile board of
1-28 Bexar County is composed of:
1-29 (1) the county judge;
1-30 (2) one county commissioner appointed by the
1-31 commissioners court;
1-32 (3) the judge of each court designated as a juvenile
1-33 court;
1-34 (4) the local administrative district judge;
1-35 (5) one judge of a district court <and the district
1-36 judges> in Bexar County that gives preference to criminal matters,
1-37 appointed by the judges of those courts;
1-38 (6) one judge of a district court in Bexar County that
1-39 gives preference to civil matters, appointed by the judges of those
1-40 courts; and
1-41 (7) the chairman of the juvenile board advisory
1-42 council created under Section 152.0010.
1-43 (b) The appointed members serve one-year terms
1-44 <commissioners court shall pay the county judge additional annual
1-45 compensation of $4,500. The county commissioners court shall pay
1-46 the district judges on the board an additional annual salary of
1-47 $1,500. The additional compensation paid to the county and
1-48 district judges shall be paid in equal monthly installments from
1-49 the general fund of the county>.
1-50 (c) The juvenile board shall hold an annual meeting in
1-51 January and at this meeting shall elect a chairman from among the
1-52 members. The board shall hold other meetings as determined by the
1-53 board at its January meeting and may meet at the call of the
1-54 chairman or at the request to the chairman of at least two members
1-55 <at least once every three months in accordance with board rules>.
1-56 <(d)> The board shall keep accurate and complete minutes of
1-57 its meetings. The minutes are open to public inspection <records
1-58 as required by law and board rules>.
1-59 (d) All county facilities and programs for children, other
1-60 than the facilities and programs operated by the Bexar County
1-61 Hospital District or the local mental health or mental retardation
1-62 authority serving Bexar County, are under the board's jurisdiction.
1-63 (e) The juvenile board shall set policies for the juvenile
1-64 probation department and other departments, facilities, and
1-65 programs under the board's jurisdiction <A juvenile probation
1-66 officer shall take the oath of office when appointed and the oath
1-67 and the fact of the appointment shall be filed with the county
1-68 clerk>.
2-1 (f) The juvenile board shall make an annual report to the
2-2 commissioners court that relates to the operation and efficiency of
2-3 the juvenile probation department, the county and other
2-4 institutions for the care of neglected, dependent, and delinquent
2-5 children, and the other facilities and programs under the board's
2-6 jurisdiction and to the general adequacy of the juvenile services
2-7 provided by the county. The board shall include in the report any
2-8 recommendations for improvements the board considers necessary
2-9 <commissioners court shall provide the juvenile probation officers
2-10 with:>
2-11 <(1) automobiles and their maintenance and operation
2-12 expenses for use in official duties; or>
2-13 <(2) an automobile allowance for the use of a personal
2-14 automobile on official business in the amount determined to be
2-15 necessary by the commissioners court>.
2-16 (g) The juvenile board shall submit a budget of expenditures
2-17 of county funds to the commissioners court. The juvenile board may
2-18 not make an expenditure of county funds unless the expenditure is
2-19 approved by the commissioners court.
2-20 (h) The juvenile board may investigate the operations of the
2-21 juvenile probation department, the county institutions for the care
2-22 of neglected, dependent, or delinquent children, or any other
2-23 facility or program under the board's jurisdiction at the request
2-24 of the judges of the district courts in Bexar County. The board
2-25 shall make a written report of the investigation to the
2-26 commissioners court <commissioners court shall provide the
2-27 necessary funds to pay the salaries and expenses of the juvenile
2-28 probation personnel>.
2-29 (i) <(h)> The juvenile board may make any special studies or
2-30 investigations it considers necessary to improve the operation of
2-31 the juvenile probation department and the county institutions under
2-32 its jurisdiction and shall provide a written report of the findings
2-33 to the commissioners court.
2-34 (j) The juvenile board, with the approval of the
2-35 commissioners court, may appoint a person to serve as chief
2-36 juvenile probation officer. The board, with the approval of the
2-37 commissioners court, may set the salary of the chief juvenile
2-38 probation officer. The chief juvenile probation officer serves at
2-39 the pleasure of the board.
2-40 (k) The board may apply for, accept, hold in trust, spend,
2-41 and use a gift, grant, or donation of land, money, or other
2-42 personal property from a governmental, corporate, personal, or
2-43 other source to benefit the county facilities and programs under
2-44 the board's jurisdiction.
2-45 (l) Sections 152.0002, 152.0003, 152.0004, 152.0005,
2-46 152.0006, 152.0007, and 152.0008 <152.0008(a)> do not apply to the
2-47 juvenile board of Bexar County.
2-48 SECTION 2. This Act takes effect September 1, 1993.
2-49 SECTION 3. The importance of this legislation and the
2-50 crowded condition of the calendars in both houses create an
2-51 emergency and an imperative public necessity that the
2-52 constitutional rule requiring bills to be read on three several
2-53 days in each house be suspended, and this rule is hereby suspended.
