                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to an emergency order to protect a child.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 17.02(d), Family Code, is amended to read
    1-5  as follows:
    1-6        (d)  In determining whether there is an immediate danger to
    1-7  the physical health or safety of a child, the court may consider
    1-8  whether the person who has possession of the child has:
    1-9              (1)  abused or neglected another child in a manner that
   1-10  caused serious injury to or the death of the other child; or
   1-11              (2)  sexually abused another child.
   1-12        SECTION 2.  This Act takes effect September 1, 1993.
   1-13        SECTION 3.  The importance of this legislation and the
   1-14  crowded condition of the calendars in both houses create an
   1-15  emergency   and   an   imperative   public   necessity   that   the
   1-16  constitutional rule requiring bills to be read on three several
   1-17  days in each house be suspended, and this rule is hereby suspended.
