                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the determination of value in condemnation proceedings.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 21.042(b), Property Code, is amended to
    1-5  read as follows:
    1-6        (b)  If an entire tract or parcel of real property is
    1-7  condemned, the damage to the property owner is the local market
    1-8  value of the property determined:
    1-9              (1)  at the time of the special commissioners' hearing;
   1-10  and
   1-11              (2)  as if the public use for which the property is
   1-12  condemned had not been proposed and will not occur, if the
   1-13  announcement of the proposed public use decreases the local market
   1-14  value.
   1-15        SECTION 2.  The change in law made by this Act applies to a
   1-16  condemnation proceeding filed on or after the effective date of
   1-17  this Act.  A condemnation proceeding pending before the effective
   1-18  date of this Act is covered by the law in effect when the suit was
   1-19  filed, and the former law is continued in effect for this purpose.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
