1-17 A BILL TO BE ENTITLED
1-18 AN ACT
1-19 relating to the exemption of certain psychologists from career
1-20 counseling services requirements.
1-21 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-22 SECTION 1. Section 2, Chapter 222, Acts of the 70th
1-23 Legislature, Regular Session, 1987 (Article 5221a-8, Vernon's Texas
1-24 Civil Statutes), is amended to read as follows:
1-25 Sec. 2. Exceptions. This Act does not apply to:
1-26 (1) a person regulated by Chapter 263, Acts of the
1-27 66th Legislature, Regular Session, 1979 (Article 5221a-7, Vernon's
1-28 Texas Civil Statutes);
1-29 (2) a personnel service operated by the United States,
1-30 this state, any political subdivision of this state, or any
1-31 organization receiving appropriated funds from or under contract
1-32 with those governmental entities;
1-33 (3) a professional counselor licensed under the
1-34 Licensed Professional Counselor Act (Article 4512g, Vernon's Texas
1-35 Civil Statutes); <or>
1-36 (4) a nonprofit organization qualifying under Section
1-37 501(c)(3) of the Internal Revenue Code of 1986, providing a service
1-38 described in this Act as part of its charitable purposes; or
1-39 (5) a person licensed as a psychologist under the
1-40 Psychologists' Certification and Licensing Act (Article 4512c,
1-41 Vernon's Texas Civil Statutes) when practicing within the scope of
1-42 the license.
1-43 SECTION 2. The importance of this legislation and the
1-44 crowded condition of the calendars in both houses create an
1-45 emergency and an imperative public necessity that the
1-46 constitutional rule requiring bills to be read on three several
1-47 days in each house be suspended, and this rule is hereby suspended,
1-48 and that this Act take effect and be in force from and after its
1-49 passage, and it is so enacted.
