                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the local regulation of the location of businesses
    1-3  selling alcoholic beverages.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 109.33, Alcoholic Beverage Code, is
    1-6  amended by adding Subsection (f) to read as follows:
    1-7        (f)  The commissioners court of a county may enact
    1-8  regulations applicable in areas in the county outside a
    1-9  municipality, and the governing body of a municipality may enact
   1-10  regulations applicable in the municipality, prohibiting the sale of
   1-11  alcoholic beverages on the premises of a sexually oriented business
   1-12  that is within 3,000 feet of a church, school, hospital,
   1-13  playground, athletic field used by persons under 18 years of age,
   1-14  residential neighborhood, or other property the commissioners court
   1-15  or governing body finds to be inconsistent with the operation of a
   1-16  sexually oriented business.  For the purposes of this subsection,
   1-17  the measurement of the distance between the place of business where
   1-18  alcoholic beverages are sold and the property involved is from the
   1-19  nearest property line of the property to the nearest doorway by
   1-20  which the public may enter the place of business, along street
   1-21  lines and in direct line across intersections.
   1-22        SECTION 2.  This Act takes effect September 1, 1993.
   1-23        SECTION 3.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended.
