                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the repeal of the offense of homosexual conduct.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 21.06, Penal Code, is repealed.
    1-5        SECTION 2.  An offense under Section 21.06, Penal Code, may
    1-6  not be prosecuted after the effective date of this Act.  If on the
    1-7  effective date of this Act a criminal action is pending for an
    1-8  offense under Section 21.06, the action is dismissed on that date.
    1-9  However, a final conviction for an offense under Section 21.06 that
   1-10  exists on the effective date of this Act is unaffected by this Act.
   1-11        SECTION 3.  This Act takes effect September 1, 1993.
   1-12        SECTION 4.  The importance of this legislation and the
   1-13  crowded condition of the calendars in both houses create an
   1-14  emergency and an imperative public necessity that the
   1-15  constitutional rule requiring bills to be read on three several
   1-16  days in each house be suspended, and this rule is hereby suspended.
