                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the fee collected by an agent who issues certain
    1-3  licenses under the Parks and Wildlife Code.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.056(c), Parks and Wildlife Code, is
    1-6  amended to read as follows:
    1-7        (c)  An authorized agent of the department, other than a
    1-8  department employee, who sells the wildlife art decals or stamps
    1-9  may retain $1 or an amount set by the commission, whichever amount
   1-10  is more, <50 cents> of each item sold as a collection fee.
   1-11        SECTION 2.  Section 42.012(a), Parks and Wildlife Code, is
   1-12  amended to read as follows:
   1-13        (a)  The fee for a resident hunting license is $8 or an
   1-14  amount set by the commission, whichever amount is more.  One dollar
   1-15  <Fifty cents> of the fee or an amount set by the commission,
   1-16  whichever amount is more, may be retained by an authorized agent,
   1-17  other than a department employee, issuing the license as his
   1-18  collection fee.
   1-19        SECTION 3.  Section 42.0121, Parks and Wildlife Code, is
   1-20  amended to read as follows:
   1-21        Sec. 42.0121.  LIFETIME RESIDENT HUNTING LICENSE FEE.  The
   1-22  fee for a lifetime resident hunting license is $300 or an amount
   1-23  set by the commission, whichever amount is more.  One dollar <Fifty
   1-24  cents> of the fee or an amount set by the commission, whichever
    2-1  amount is more, may be retained by an authorized agent, other than
    2-2  a department employee, issuing the license as his collection fee.
    2-3        SECTION 4.  Section 42.014, Parks and Wildlife Code, is
    2-4  amended to read as follows:
    2-5        Sec. 42.014.  NONRESIDENT SPECIAL LICENSE FEE.  The fee for a
    2-6  nonresident special hunting license is $37.75 or an amount set by
    2-7  the commission, whichever amount is more.  One dollar and fifty
    2-8  <Seventy-five> cents of the fee or an amount set by the commission,
    2-9  whichever amount is more, may be retained by the officer, other
   2-10  than a department employee, issuing the license as his collection
   2-11  fee.
   2-12        SECTION 5.  Section 42.0141, Parks and Wildlife Code, is
   2-13  amended to read as follows:
   2-14        Sec. 42.0141.  GENERAL NONRESIDENT HUNTING LICENSE FEE.  The
   2-15  fee for a general nonresident hunting license is $100.75 or an
   2-16  amount set by the commission, whichever amount is more.  One dollar
   2-17  and fifty <Seventy-five> cents of the fee or an amount set by the
   2-18  commission, whichever amount is more, may be retained by the
   2-19  officer, other than a department employee, issuing the license as
   2-20  his collection fee.
   2-21        SECTION 6.  Section 42.0142(b), Parks and Wildlife Code, is
   2-22  amended to read as follows:
   2-23        (b)  The fee for a nonresident banded bird hunting license is
   2-24  set by the commission in an amount not to exceed $10.  One dollar
   2-25  and fifty <Seventy-five> cents of the fee or an amount set by the
   2-26  commission, whichever amount is more, may be retained by an
   2-27  authorized agent, other than a department employee, issuing the
    3-1  license as his collection fee.  A nonresident banded bird hunting
    3-2  license may be sold by the department or private bird hunting area
    3-3  licensee subject to the same rules that apply to any other license
    3-4  deputy.
    3-5        SECTION 7.  Section 42.0143, Parks and Wildlife Code, is
    3-6  amended to read as follows:
    3-7        Sec. 42.0143.  NONRESIDENT FIVE-DAY SPECIAL HUNTING LICENSE.
    3-8  A nonresident five-day special hunting license is valid for five
    3-9  consecutive days.  The fee for the license is set by the commission
   3-10  in an amount not to exceed 50 percent of the amount of the fee set
   3-11  for a nonresident special hunting license.  One dollar and fifty
   3-12  <Seventy-five> cents of the fee or an amount set by the commission,
   3-13  whichever amount is more, may be retained by an authorized agent,
   3-14  other than a department employee, issuing the license as his
   3-15  collection fee.
   3-16        SECTION 8.  Section 42.0144, Parks and Wildlife Code, is
   3-17  amended to read as follows:
   3-18        Sec. 42.0144.  NONRESIDENT SPRING TURKEY HUNTING LICENSE FEE.
   3-19  (a)  The fee for a nonresident spring turkey hunting license is $75
   3-20  or an amount set by the commission, whichever amount is more.
   3-21        (b)  The commission may set an amount of the license fee that
   3-22  may be retained as a collection fee by an authorized agent, other
   3-23  than a department employee, who issues a license.
   3-24        SECTION 9.  Section 42.017(d), Parks and Wildlife Code, is
   3-25  amended to read as follows:
   3-26        (d)  The fee for a duplicate license or tags is $5 or an
   3-27  amount set by the commission, whichever amount is more.  One dollar
    4-1  <Fifty cents> of the fee or an amount set by the commission,
    4-2  whichever amount is more, may be retained by the officer, other
    4-3  than a department employee, issuing the license as his collection
    4-4  fee.
    4-5        SECTION 10.  Section 43.014(a), Parks and Wildlife Code, is
    4-6  amended to read as follows:
    4-7        (a)  One dollar <Fifty cents> of the fee collected under this
    4-8  subchapter or an amount set by the commission, whichever amount is
    4-9  more, may be retained by the agent of the department, other than a
   4-10  department employee, as his collection fee.
   4-11        SECTION 11.  Section 43.202, Parks and Wildlife Code, is
   4-12  amended to read as follows:
   4-13        Sec. 43.202.  FEE.  The fee for an archery hunting stamp is
   4-14  $6 or an amount set by the commission, whichever amount is more.
   4-15  One dollar or an amount set by the commission, whichever amount is
   4-16  more, <Fifty cents> shall be retained by the agent issuing the
   4-17  stamp as a collection fee, except that employees of the department
   4-18  may not retain the collection fee.
   4-19        SECTION 12.  Section 43.254(a), Parks and Wildlife Code, is
   4-20  amended to read as follows:
   4-21        (a)  One dollar <Fifty cents> of the fee collected under this
   4-22  subchapter or an amount set by the commission, whichever amount is
   4-23  more, may be retained by the agent of the department, other than a
   4-24  department employee, as a collection fee.
   4-25        SECTION 13.  Section 43.305(a), Parks and Wildlife Code, is
   4-26  amended to read as follows:
   4-27        (a)  One dollar <Fifty cents> of the fee collected under this
    5-1  subchapter or an amount set by the commission, whichever amount is
    5-2  more, may be retained by the agent of the department, other than a
    5-3  department employee, as a collection fee.
    5-4        SECTION 14.  Section 43.405(a), Parks and Wildlife Code, is
    5-5  amended to read as follows:
    5-6        (a)  One dollar <Fifty cents> of the fee collected under this
    5-7  subchapter or an amount set by the commission, whichever amount is
    5-8  more, shall be retained by the agent of the department, other than
    5-9  a department employee, as a collection fee.
   5-10        SECTION 15.  Section 43.505(a), Parks and Wildlife Code, is
   5-11  amended to read as follows:
   5-12        (a)  One dollar <Fifty cents> of the fee collected under this
   5-13  subchapter or an amount set by the commission, whichever amount is
   5-14  more, may be retained by the agent of the department, other than a
   5-15  department employee, as a collection fee.
   5-16        SECTION 16.  Section 43.524(a), Parks and Wildlife Code, is
   5-17  amended to read as follows:
   5-18        (a)  One dollar <Fifty cents> of each conservation permit fee
   5-19  collected under Section 43.522 of this code by an agent of the
   5-20  department, other than a department employee, or an amount set by
   5-21  the commission, whichever amount is more, may be retained as a
   5-22  collection fee by the agent.
   5-23        SECTION 17.  Section 46.004(d), Parks and Wildlife Code, is
   5-24  amended to read as follows:
   5-25        (d)  The license deputy issuing the license may retain $1 or
   5-26  an amount set by the commission, whichever amount is more, <50
   5-27  cents> as a fee for collecting the license fee and issuing the
    6-1  license.
    6-2        SECTION 18.  Section 46.005(b), Parks and Wildlife Code, is
    6-3  amended to read as follows:
    6-4        (b)  The fee for the temporary sportfishing license is $5 or
    6-5  an amount set by the commission, whichever amount is more.  One
    6-6  dollar or an amount set by the commission, whichever amount is
    6-7  more, <Fifty cents> may be retained as a collection fee by the
    6-8  issuing officer, other than a department employee.
    6-9        SECTION 19.  Section 46.0051(b), Parks and Wildlife Code, is
   6-10  amended to read as follows:
   6-11        (b)  The license fee is $7 or an amount set by the
   6-12  commission, whichever amount is more.  One dollar <Fifty cents> of
   6-13  the fee or an amount set by the commission, whichever amount is
   6-14  more, may be retained as a collection fee by the issuing officer,
   6-15  other than a department employee.
   6-16        SECTION 20.  Section 46.006(c), Parks and Wildlife Code, is
   6-17  amended to read as follows:
   6-18        (c)  The license deputy issuing the license may retain $1 or
   6-19  an amount set by the commission, whichever amount is more,  <50
   6-20  cents> as a fee for issuing the duplicate license.
   6-21        SECTION 21.  Section 46.104(b), Parks and Wildlife Code, is
   6-22  amended to read as follows:
   6-23        (b)  The fee for the license is $5.75 or an amount set by the
   6-24  commission, whichever amount is more.  One dollar and fifty
   6-25  <Seventy-five> cents of the fee or an amount set by the commission,
   6-26  whichever amount is more, may be retained by the issuing officer,
   6-27  other than a department employee.
    7-1        SECTION 22.  Section 46.105(b), Parks and Wildlife Code, is
    7-2  amended to read as follows:
    7-3        (b)  The fee for the license is $1.25 or an amount set by the
    7-4  commission, whichever amount is more.  Thirty <Fifteen> cents of
    7-5  the fee or an amount set by the commission, whichever amount is
    7-6  more, may be retained by the officer issuing the license, other
    7-7  than a department employee.
    7-8        SECTION 23.  Section 50.002(c), Parks and Wildlife Code, is
    7-9  amended to read as follows:
   7-10        (c)  Authorized agents of the department, other than
   7-11  employees of the department, may retain $2 <$1> of the fee  or an
   7-12  amount set by the commission, whichever amount is more, as a
   7-13  collection fee.
   7-14        SECTION 24.  Section 71.013, Parks and Wildlife Code, is
   7-15  amended to read as follows:
   7-16        Sec. 71.013.  FEES OF ISSUING AGENTS.  County clerks and
   7-17  other authorized agents of the department other than employees of
   7-18  the department may retain $1.50 <75 cents> of the fee or an amount
   7-19  set by the commission, whichever amount is more, for the issuance
   7-20  of a trapper's license, a retail fur buyer's license, or a
   7-21  wholesale fur dealer's license as a collection fee.
   7-22        SECTION 25.  The changes in law made by this Act apply only
   7-23  to a fee collected for a license, stamp, or tag issued on or after
   7-24  the effective date of this Act.
   7-25        SECTION 26.  This Act takes effect September 1, 1993.
   7-26        SECTION 27.  The importance of this legislation and the
   7-27  crowded condition of the calendars in both houses create an
    8-1  emergency   and   an   imperative   public   necessity   that   the
    8-2  constitutional rule requiring bills to be read on three several
    8-3  days in each house be suspended, and this rule is hereby suspended.
