                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to pipeline easements granted or taken before 1960.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter B, Chapter 111, Natural Resources
    1-5  Code, is amended by adding Section 111.0194 to read as follows:
    1-6        Sec. 111.0194.  PIPELINE EASEMENT GRANTED OR CONDEMNED BEFORE
    1-7  1960.  A surface easement created by grant or through the power of
    1-8  eminent domain for the benefit of a common carrier before 1960 is
    1-9  presumed, unless the terms of the grant or the condemnation
   1-10  petition expressly provide otherwise, to create an easement in
   1-11  favor of the common carrier or a successor in interest to the
   1-12  common carrier that:
   1-13              (1)  extends 15 feet from either side of the centerline
   1-14  of the first pipeline laid in the easement; and
   1-15              (2)  limits pipeline placement rights to the horizontal
   1-16  alignment of the pipeline being replaced.
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
