                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to service creditable in the elected class of membership
    1-3  of the Employees Retirement System of Texas.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter E, Chapter 813, Government Code, is
    1-6  amended by adding Section 813.406 to read as follows:
    1-7        Sec. 813.406.  SERVICE BY CERTAIN JUDICIAL OFFICERS.  (a)  A
    1-8  contributing member of the Judicial Retirement System of Texas Plan
    1-9  One or Plan Two may establish service credit in the elected class
   1-10  of the retirement system for:
   1-11              (1)  service performed as a member of the legislature;
   1-12              (2)  service performed as a state employee; and
   1-13              (3)  military service creditable in the retirement
   1-14  system.
   1-15        (b)  To establish service credit under this section, a person
   1-16  must:
   1-17              (1)  apply to the retirement system in writing; and
   1-18              (2)  deposit with the retirement system any payments
   1-19  that are required for establishment of the type of service and that
   1-20  are not currently deposited with the retirement system.
   1-21        (c)  The retirement system shall use all credit established
   1-22  under this section in determining eligibility for retirement.
   1-23        (d)  The retirement system may not grant credit for military
   1-24  service under this section if that service is credited in another
    2-1  public retirement system.
    2-2        SECTION 2.  The importance of this legislation and the
    2-3  crowded condition of the calendars in both houses create an
    2-4  emergency and an imperative public necessity that the
    2-5  constitutional rule requiring bills to be read on three several
    2-6  days in each house be suspended, and this rule is hereby suspended,
    2-7  and that this Act take effect and be in force from and after its
    2-8  passage, and it is so enacted.
