                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to restrictions on the issuance of permits for certain
    1-3  hazardous, chemical, or medical waste disposal facilities.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter C, Chapter 361, Health and  Safety
    1-6  Code, is amended by adding Section 361.1021 to read as follows:
    1-7        Sec. 361.1021.  PROHIBITION ON PERMIT FOR HAZARDOUS,
    1-8  CHEMICAL, OR MEDICAL  WASTE DISPOSAL FACILITY WITHIN TWO MILES OF
    1-9  RESIDENCE.  The commission by rule shall prohibit the issuance of a
   1-10  permit for a new hazardous waste, chemical waste, or medical waste
   1-11  disposal facility if the facility is to be located within two miles
   1-12  of an established residence.
   1-13        SECTION 2.  This Act takes effect September 1, 1993, and
   1-14  applies only to an application for a permit for a new hazardous
   1-15  waste, chemical waste, or medical waste disposal facility issued
   1-16  under Chapter 361, Health and Safety Code, that is:
   1-17              (1)  pending before the Texas Water Commission or its
   1-18  successor on the effective date of this Act; or
   1-19              (2)  received by the Texas Water Commission or its
   1-20  successor on or after that date.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency   and   an   imperative   public   necessity   that   the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
