No. 772 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the disposition of abandoned or unclaimed property. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Article 18.17, Code of Criminal Procedure, is 1-5 amended by adding Subsection (h) to read as follows: 1-6 (h) If the abandoned or unclaimed personal property is 1-7 money, the municipal or county purchasing agent, or the sheriff of 1-8 the county, as appropriate, may, after giving notice under 1-9 Subsection (b) or (c) of this article, deposit the money in the 1-10 treasury of the municipality or county giving notice without 1-11 conducting the sale as required by Subsection (d) of this article. 1-12 SECTION 2. The importance of this legislation and the 1-13 crowded condition of the calendars in both houses create an 1-14 emergency and an imperative public necessity that the 1-15 constitutional rule requiring bills to be read on three several 1-16 days in each house be suspended, and this rule is hereby suspended, 1-17 and that this Act take effect and be in force from and after its 1-18 passage, and it is so enacted. 1-19 COMMITTEE AMENDMENT NO. 1 1-20 Amend H.B. 772 as follows: 1-21 (1) On page 1, between lines 11 and 12, add a new Section 2 1-22 to read as follows: 1-23 "SECTION 2. Art. 18.17(f), Code of Criminal Procedure, is 1-24 amended to read as follows: 2-1 "(f) For the purposes of this article, "purchasing agent of 2-2 the municipality" means the person who is primarily responsible for 2-3 making purchases on behalf of a municipality or a person designated 2-4 by the municipality." 2-5 (2) Renumber subsequent sections as appropriate. 2-6 Hartnett
