No. 787 73R1408 SOS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the purchase of certain service credit in the Employees 1-3 Retirement System of Texas. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter F, Chapter 813, Government Code, is 1-6 amended by adding Section 813.510 to read as follows: 1-7 Sec. 813.510. CREDIT FOR TEACHER RETIREMENT SYSTEM SERVICE. 1-8 (a) In this section, "teacher retirement system" means the Teacher 1-9 Retirement System of Texas. 1-10 (b) A member may establish service credit in the employee 1-11 class for service that was creditable in the teacher retirement 1-12 system at the time the service was performed. 1-13 (c) The member may apply to establish service credit under 1-14 this section by filing an application with the retirement system. 1-15 (d) After an application is filed under Subsection (c), the 1-16 retirement system shall notify the teacher retirement system and 1-17 request a certification of the applicant's dates of employment and 1-18 salary for service that is the subject of the application. 1-19 (e) After a certification is issued under this section, the 1-20 retirement system shall grant the applicant service credit for the 1-21 service that is the subject of the application and certification, 1-22 on receipt of: 1-23 (1) a contribution in the amount of the combined 1-24 member and state contributions to the teacher retirement system 2-1 that were required by law at the time credit for the service was 2-2 established; 2-3 (2) any membership fees required of members of the 2-4 teacher retirement system during the period in which the service 2-5 was performed, except membership fees for any year in which a 2-6 membership fee was paid by the applicant to this retirement system; 2-7 and 2-8 (3) interest on the amount determined under 2-9 Subdivision (1) computed on the basis of the state fiscal year at 2-10 an annual rate of 10 percent, compounded annually, from the date 2-11 the service was performed to the date of deposit under this 2-12 section. 2-13 (f) Credit may not be established under this section if 2-14 credit for the same service is credited in the teacher retirement 2-15 system. 2-16 SECTION 2. The importance of this legislation and the 2-17 crowded condition of the calendars in both houses create an 2-18 emergency and an imperative public necessity that the 2-19 constitutional rule requiring bills to be read on three several 2-20 days in each house be suspended, and this rule is hereby suspended, 2-21 and that this Act take effect and be in force from and after its 2-22 passage, and it is so enacted.
