1-20 COMMITTEE AMENDMENT NO. 1 By: Leedom
1-21 Amend House Bill No. 795 by adding a new Section 2 to read as
1-22 follows: and by renumbering subsections sections accordingly:
1-23 SECTION 2. Subchapter C, Chapter 281, Health and Safety Code
1-24 is amended by adding Section 281.0515 to read as follows:
1-25 Sec. 281.0515. PROCEDURES FOR HEALTH MAINTENANCE
1-26 ORGANIZATION. A district may establish a health maintenance
1-27 organization in accordance with the Texas Health Maintenance
1-28 Organization Act (Chapter 20A, Vernon's Texas Insurance Code) to
1-29 provide or arrange for health care services for the residents of
1-30 the district.
1-31 A BILL TO BE ENTITLED
1-32 AN ACT
1-33 relating to the contracting authority and procedures of certain
1-34 hospital districts.
1-35 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-36 SECTION 1. Section 281.051, Health and Safety Code, is
1-37 amended by adding Subsection (d) as follows:
1-38 (d) The board shall encourage and promote participation by
1-39 all sectors of the business community, including small businesses
1-40 and businesses owned by members of a minority group or by women, in
1-41 the process by which the district enters into contracts. The board
1-42 shall develop a plan for the district to identify and remove
1-43 barriers that do not have a definite or objective relationship to
1-44 quality or competence and that unfairly discriminate against small
1-45 businesses and businesses owned by members of a minority or by
1-46 women. These barriers may include contracting procedures and
1-47 contract specifications or conditions.
1-48 SECTION 2. The importance of this legislation and the
1-49 crowded condition of the calendars in both houses create an
1-50 emergency and an imperative public necessity that the
1-51 constitutional rule requiring bills to be read on three several
1-52 days in each house be suspended, and this rule is hereby suspended,
1-53 and that this Act take effect and be in force from and after its
1-54 passage, and it is so enacted.
