1-20 AN ACT
1-21 relating to school district use of a discriminatory athletic club
1-22 for extracurricular activities.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Subchapter Z, Chapter 21, Education Code, is
1-25 amended by adding Section 21.9205 to read as follows:
1-26 Sec. 21.9205. EXTRACURRICULAR ACTIVITIES; USE OF
1-27 DISCRIMINATORY ATHLETIC CLUB. (a) An extracurricular activity
1-28 sponsored or sanctioned by a school district, including an athletic
1-29 event or an athletic team practice, may not take place at an
1-30 athletic club located in the United States that denies any person
1-31 full and equal enjoyment of equipment or facilities provided by the
1-32 athletic club because of the race, color, religion, creed, national
1-33 origin, or sex of the person.
1-34 (b) In this section, "athletic club" means an entity that
1-35 provides sports or exercise equipment or facilities to its
1-36 customers or members or to the guests of its customers or members.
1-37 SECTION 2. This Act takes effect September 1, 1993.
1-38 SECTION 3. The importance of this legislation and the
1-39 crowded condition of the calendars in both houses create an
1-40 emergency and an imperative public necessity that the
1-41 constitutional rule requiring bills to be read on three several
1-42 days in each house be suspended, and this rule is hereby suspended.
