1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the composition, termination, and duties of the
1-22 Legislative Natural Resources Board.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 10.02, Chapter 3, Acts of the 72nd
1-25 Legislature, 1st Called Session, 1991, is amended to read as
1-26 follows:
1-27 Sec. 10.02. The board is composed of:
1-28 (1) the chair of the House Environmental Regulation
1-29 <Affairs> Committee;
1-30 (2) the chair of the Senate Natural Resources
1-31 Committee;
1-32 (3) the chair of the House Natural Resources
1-33 Committee;
1-34 (4) the chair of the Senate Finance Committee;
1-35 (5) the chair of the House Appropriations <Government
1-36 Organization> Committee; and
1-37 (6) the chair of the Senate State Affairs Committee.
1-38 Each member of the board may designate a member of the
1-39 standing committee he chairs to serve on his behalf in the absence
1-40 of the committee chair.
1-41 SECTION 2. Section 10.03, Chapter 3, Acts of the 72nd
1-42 Legislature, 1st Called Session, 1991, is amended to read as
1-43 follows:
1-44 Sec. 10.03. The board shall oversee and review the
1-45 implementation of legislative natural resources policy by state
1-46 agencies that have the statutory duty to implement that policy.
1-47 The board shall oversee and review the implementation of federal
1-48 environmental programs delegated to the state. The board shall
1-49 oversee and enforce compliance with the Administrative Procedure
1-50 and Texas Register Act (Article 6252-13a, Vernon's Texas Civil
1-51 Statutes). The board may require information and reports from
1-52 state agencies as necessary to carry out its oversight and review
1-53 duties. The board may appoint subcommittees made up from the
1-54 membership of the standing committees represented on the board.
1-55 SECTION 3. Section 10.04, Chapter 3, Acts of the 72nd
1-56 Legislature, 1st Called Session, 1991, is amended to read as
1-57 follows:
1-58 Sec. 10.04. The board may receive grants, appropriations, or
1-59 property from any source. The board may contract with state or
1-60 federal agencies to support the implementation of legislative
1-61 natural resource policy. <shall continue its review and oversight
1-62 activities during the transition period to the full Texas Natural
1-63 Resources Conservation Commission. The board shall terminate its
1-64 duties effective January 1, 1994.>
1-65 SECTION 4. Section 10.05, Chapter 3, Acts of the 72nd
1-66 Legislature, 1st Called Session, 1991, is amended to read as
1-67 follows:
1-68 Sec. 10.05. At a minimum, the board shall ensure that agency
2-1 <transition> activities <do not>:
2-2 (1) do not delay or prejudice any permit processing
2-3 activities;
2-4 (2) do not result in undue duplication of effort;
2-5 (3) do not impede progress toward activities ensuring
2-6 the delegation of federal environmental programs; <and>
2-7 (4) ensure compliance with the provisions of this Act;
2-8 and
2-9 (5) do not result in duplicative or conflicting rules.
2-10 SECTION 5. The importance of this legislation and the
2-11 crowded condition of the calendars in both houses create an
2-12 emergency and an imperative public necessity that the
2-13 constitutional rule requiring bills to be read on three several
2-14 days in each house be suspended, and this rule is hereby suspended,
2-15 and that this Act take effect and be in force from and after its
2-16 passage, and it is so enacted.
