A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the creation of the offense of possession, manufacture,
1-3 transportation, repair, or sale of an assault weapon.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 46.01, Penal Code, is amended by adding
1-6 Subdivision (17) to read as follows:
1-7 (17) "Assault weapon" means:
1-8 (A) the following firearms:
1-9 (i) Armalite AR-180;
1-10 (ii) Auto-Ordnance Thompson models 1927
1-11 and M-1;
1-12 (iii) Avtomat Kalashnikov (all models);
1-13 (iv) Barrett Light-Fifty model 82A1;
1-14 (v) Beretta AR-70;
1-15 (vi) Bushmaster Auto Rifle and Auto
1-16 Pistol;
1-17 (vii) Calico models M-900, M-950, and
1-18 100-P;
1-19 (viii) Colt AR-15;
1-20 (ix) Daewoo Max-1 and Max-2;
1-21 (x) Encom MK-IV, MP-9, and MP 45;
1-22 (xi) Fabrique Nationale FN/FAL, FN/LAR,
1-23 and FNC;
1-24 (xii) FAMAS MAS 223;
2-1 (xiii) Feather AT-9 and Mini-AT;
2-2 (xiv) Federal XC-900 and XC-450;
2-3 (xv) Franchi SPAS-12 and LAW-12;
2-4 (xvi) Galil AR and ARM;
2-5 (xvii) Gilbert USAS-12;
2-6 (xviii) Heckler & Koch HK-91, HK-93,
2-7 HK-94, and SP-89;

2-24 (xxxiii) Weaver Arms Nighthawk;
2-25 (B) any firearm that is identical to a firearm
2-26 listed in this subdivision except for a slight modification or
2-27 enhancement, including a:
3-1 (i) folding or retractable stock;
3-2 (ii) different sight;
3-3 (iii) case deflector for left-handed
3-4 shooters;
3-5 (iv) shorter barrel;
3-6 (v) stock of different composition;
3-7 (vi) larger ammunition capacity; or
3-8 (vii) different caliber;
3-9 (C) any part or combination of parts designed or
3-10 intended to readily convert a firearm into a firearm listed in this
3-11 subdivision;
3-12 (D) any semiautomatic rifle or pistol with a
3-13 magazine capable of holding 20 rounds or more; or
3-14 (E) any semiautomatic shotgun with a magazine
3-15 capable of holding seven rounds or more.
3-16 SECTION 2. Section 46.06(a), Penal Code, is amended to read
3-17 as follows:
3-18 (a) A person commits an offense if he intentionally or
3-19 knowingly possesses, manufactures, transports, repairs, or sells:
3-20 (1) an explosive weapon;
3-21 (2) a machine gun;
3-22 (3) a short-barrel firearm;
3-23 (4) a firearm silencer;
3-24 (5) a switchblade knife;
3-25 (6) knuckles;
3-26 (7) armor-piercing ammunition;
3-27 (8) a chemical dispensing device; <or>
4-1 (9) a zip gun; or
4-2 (10) an assault weapon.
4-3 SECTION 3. This Act takes effect September 1, 1993.
4-4 SECTION 4. The importance of this legislation and the
4-5 crowded condition of the calendars in both houses create an
4-6 emergency and an imperative public necessity that the
4-7 constitutional rule requiring bills to be read on three several
4-8 days in each house be suspended, and this rule is hereby suspended.
