A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to extended hours for the sale, delivery, consumption, and
1-3 possession of alcoholic beverages.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 105.05(c) and (d), Alcoholic Beverage
1-6 Code, are amended to read as follows:
1-7 (c) In a county having a population of 500,000 <300,000> or
1-8 more, according to the last preceding federal census, a holder of a
1-9 retail dealer's on-premise late hours license may also sell, offer
1-10 for sale, and deliver beer between midnight and 2 a.m. on any day.
1-11 (d) In a county having a population of less than 500,000
1-12 <300,000>, according to the last preceding federal census, the
1-13 extended hours prescribed in Subsection (c) of this section are
1-14 effective for the sale, offer to sell, and delivery of beer by a
1-15 holder of a retail dealer's on-premise late hours license:
1-16 (1) in the unincorporated areas of the county if the
1-17 extended hours are adopted by an order of the commissioners court;
1-18 and
1-19 (2) in an incorporated city or town if the extended
1-20 hours are adopted by an ordinance of the governing body of the city
1-21 or town.
1-22 SECTION 2. Section 105.06(a), Alcoholic Beverage Code, is
1-23 amended to read as follows:
1-24 (a) In this section:
2-1 (1) "Extended hours area" means an area<:>
2-2 <(A) located in a county having a population of
2-3 more than 300,000, according to the last preceding federal census;
2-4 or>
2-5 <(B) located in a county having a population of
2-6 not more than 300,000, according to the last preceding federal
2-7 census, if the area has been made> subject to the extended hours of
2-8 sale provided in Section 105.03 or 105.05 of this code.
2-9 (2) "Standard hours area" means an area which is not
2-10 an extended hours area.
2-11 SECTION 3. This Act takes effect September 1, 1993.
2-12 SECTION 4. The importance of this legislation and the
2-13 crowded condition of the calendars in both houses create an
2-14 emergency and an imperative public necessity that the
2-15 constitutional rule requiring bills to be read on three several
2-16 days in each house be suspended, and this rule is hereby suspended.
