                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to a two-year moratorium on unfunded mandates imposed on
    1-3  school districts by the state.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter Z, Chapter 21, Education Code, is
    1-6  amended by adding Section 21.938 to read as follows:
    1-7        Sec. 21.938.  MORATORIUM ON UNFUNDED MANDATES.  (a)  A school
    1-8  district is exempt from a state educational mandate for which the
    1-9  legislature has not appropriated funds sufficient to meet the
   1-10  expenditure required by the mandate.
   1-11        (b)  This section applies only to a state educational mandate
   1-12  enacted on or after January 1, 1993.
   1-13        (c)  In this section, "state educational mandate" means a
   1-14  statutory provision the implementation of which requires an
   1-15  expenditure by a school district that would not have been required
   1-16  in the absence of the statutory provision and rules adopted under
   1-17  that provision.  It does not include an expenditure required to
   1-18  comply with a law that applies to all persons similarly situated.
   1-19        (d)  This section expires September 1, 1995.
   1-20        SECTION 2.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
