A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to prohibiting employment discrimination against deputy
1-3 sheriffs in certain counties for refusing to take a polygraph
1-4 examination.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Subchapter Z, Chapter 157, Local Government Code,
1-7 is amended by adding Section 157.905 to read as follows:
1-8 Sec. 157.905. POLYGRAPH EXAMINATION OF DEPUTY SHERIFF IN
1-9 CERTAIN SHERIFF'S DEPARTMENTS. (a) This section applies only to a
1-10 person appointed as a deputy sheriff in a sheriff's department in a
1-11 county with a population of 2.8 million or more.
1-12 (b) A deputy sheriff may not be suspended, discharged, or
1-13 subjected to any other form of employment discrimination because
1-14 the deputy refuses to take a polygraph examination.
1-15 SECTION 2. The importance of this legislation and the
1-16 crowded condition of the calendars in both houses create an
1-17 emergency and an imperative public necessity that the
1-18 constitutional rule requiring bills to be read on three several
1-19 days in each house be suspended, and this rule is hereby suspended,
1-20 and that this Act take effect and be in force from and after its
1-21 passage, and it is so enacted.
