                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to improving the health and welfare of persons fishing in
    1-3  certain watercourses after which famous battlefields of the Texas
    1-4  Revolution have been named in counties with a population of more
    1-5  than 2.4 million.
    1-6        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-7        SECTION 1.  Section 361.102, Health and Safety Code, is
    1-8  amended by adding a new subsection (e) to read as follows:
    1-9        (e)  The commission and the Texas Air Control Board by rule
   1-10  shall prohibit the issuance of a permit for the construction or
   1-11  operation of a commercial hazardous waste management facility in a
   1-12  county of a population over 2.4 million if the boundary of the unit
   1-13  is located within three miles of a watercourse after which a famous
   1-14  battlefield of the Texas Revolution has been named and if such
   1-15  watercourse, or any part thereof, has been or could be used for
   1-16  fishing, whether commercial or recreational.
   1-17        SECTION 2.  Section 361.102 (e) and (f) are redesignated
   1-18  subsections (f) and (g), respectively.
   1-19        SECTION 3.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
