A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to retaining the current names of the Texas Department of
1-3 Health and the Texas Board of Health.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. The heading to Article 4413(504), Revised
1-6 Statutes, is amended to read as follows:
1-7 Art. 4413(504). TEXAS DEPARTMENT OF <PUBLIC> HEALTH
1-8 SECTION 2. Sections 1 and 2, Article 4413(504), Revised
1-9 Statutes, are amended to read as follows:
1-10 Sec. 1. DEFINITIONS. In this article:
1-11 (1) "Board" means the Texas Board of <Public> Health.
1-12 (2) "Commission" means the Health and Human Services
1-13 Commission.
1-14 (3) "Department" means the Texas Department of
1-15 <Public> Health.
1-16 (4) "Director" means the director of the Texas
1-17 Department of <Public> Health.
1-18 Sec. 2. COMPOSITION AND RESPONSIBILITY OF DEPARTMENT. The
1-19 Texas Department of <Public> Health is composed of the board, the
1-20 director, and administrative staff, and other officers and
1-21 employees necessary to efficiently carry out the purposes of this
1-22 article. The department is the state agency with primary
1-23 responsibility for providing health services, including:
1-24 (1) disease prevention;
2-1 (2) health promotion;
2-2 (3) indigent health care;
2-3 (4) certain acute care services; and
2-4 (5) other health-related services as provided by law.
2-5 SECTION 3. Section 2(3), Texas Nursing Home Administrators
2-6 Licensure Act (Article 4442d, Vernon's Texas Civil Statutes), is
2-7 amended to read as follows:
2-8 (3) "nursing home" means any institution or facility
2-9 <now or hereafter> licensed as a "nursing home" or "custodial care
2-10 home" <by the Texas State Department of Public Health> under the
2-11 provisions of Chapter 242, Health and Safety Code;
2-12 SECTION 4. Section 3(c), Chapter 65, Acts of the 41st
2-13 Legislature, 1st Called Session, 1929 (Article 8407a, Vernon's
2-14 Texas Civil Statutes), is amended to read as follows:
2-15 (c) The board shall issue a barber shop permit to an
2-16 applicant who holds a valid class A barber license and whose shop
2-17 meets the minimum health standards for barber shops as promulgated
2-18 by the Texas <State> Department of <Public> Health and all rules
2-19 and regulations of the board.
2-20 SECTION 5. Any transfer to the Department of Public Health
2-21 provided by Chapter 15, Acts of the 72nd Legislature, 1st Called
2-22 Session, 1991, means a transfer to the entity created by Article
2-23 4413(504), Revised Statutes, and renamed the Texas Department of
2-24 Health by this Act.
2-25 SECTION 6. This Act takes effect September 1, 1993.
2-26 SECTION 7. The importance of this legislation and the
2-27 crowded condition of the calendars in both houses create an
3-1 emergency and an imperative public necessity that the
3-2 constitutional rule requiring bills to be read on three several
3-3 days in each house be suspended, and this rule is hereby suspended.
