No. 1040 73R3392 CAG-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the location of certain hearings conducted under the 1-3 Alcoholic Beverage Code. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter A, Chapter 11, Alcoholic Beverage 1-6 Code, is amended by adding Section 11.015 to read as follows: 1-7 Sec. 11.015. HEARING LOCATION. Notwithstanding any other 1-8 provision of this code, a hearing related to the issuance, renewal, 1-9 cancellation, or suspension of a permit issued under this subtitle 1-10 for the operation of a licensed premises may be conducted only at: 1-11 (1) the commission's branch office in the county in 1-12 which the premises is located; or 1-13 (2) the commission's office in Travis County if the 1-14 commission does not have a branch office in the county in which the 1-15 premises is located. 1-16 SECTION 2. Subchapter B, Chapter 61, Alcoholic Beverage 1-17 Code, is amended by adding Section 61.52 to read as follows: 1-18 Sec. 61.52. HEARING LOCATION. Notwithstanding any other 1-19 provision of this code, a hearing conducted by the commission or 1-20 administrator related to the issuance or renewal of a license 1-21 issued under this subtitle for the operation of a licensed premises 1-22 may be conducted only at: 1-23 (1) the commission's branch office in the county in 1-24 which the premises is located; or 2-1 (2) the commission's office in Travis County if the 2-2 commission does not have a branch office in the county in which the 2-3 premises is located. 2-4 SECTION 3. Subchapter C, Chapter 61, Alcoholic Beverage 2-5 Code, is amended by adding Section 61.86 to read as follows: 2-6 Sec. 61.86. HEARING LOCATION. Notwithstanding any other 2-7 provision of this code, a hearing related to the cancellation or 2-8 suspension of a license issued under this subtitle for the 2-9 operation of a licensed premises may be conducted only at: 2-10 (1) the commission's branch office in the county in 2-11 which the premises is located; or 2-12 (2) the commission's office in Travis County if the 2-13 commission does not have a branch office in the county in which the 2-14 premises is located. 2-15 SECTION 4. This Act takes effect September 1, 1993, and 2-16 applies only to a hearing conducted on or after that date. 2-17 SECTION 5. The importance of this legislation and the 2-18 crowded condition of the calendars in both houses create an 2-19 emergency and an imperative public necessity that the 2-20 constitutional rule requiring bills to be read on three several 2-21 days in each house be suspended, and this rule is hereby suspended.
