A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the administration and operation of certain job
1-3 training programs.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 5(b), Texas Job-Training Partnership Act
1-6 (Article 4413(52), Vernon's Texas Civil Statutes), is amended to
1-7 read as follows:
1-8 (b) The Texas Employment Commission <Department of Commerce>
1-9 shall:
1-10 (1) have primary responsibility for implementation and
1-11 management of the job-training program; and
1-12 (2) perform such other functions and duties relating
1-13 to the job-training program as may be required by law or assigned
1-14 by the governor.
1-15 SECTION 2. Section 9A(a), Texas Job-Training Partnership Act
1-16 (Article 4413(52), Vernon's Texas Civil Statutes), is amended to
1-17 read as follows:
1-18 (a) The Texas Employment Commission <Department of Commerce>
1-19 is authorized to enter into contracts with public community and
1-20 junior colleges and private, nonprofit organizations that conduct
1-21 model or exemplary youth programs that meet the unique educational
1-22 needs of student dropouts to provide educational services to
1-23 student dropouts. A contract under this section must be made in
1-24 accordance with the same procedure by which a state agency
2-1 contracts with a private consultant under Chapter 454, Acts of the
2-2 65th Legislature, Regular Session, 1977 (Article 6252-11c, Vernon's
2-3 Texas Civil Statutes).
2-4 SECTION 3. Section 481.023(c), Government Code, is amended
2-5 to read as follows:
2-6 (c) The department shall perform the administrative duties
2-7 formerly assigned to the Texas Department of Community Affairs
2-8 under the <Texas Job-Training Partnership Act (Article 4413(52),
2-9 Vernon's Texas Civil Statutes) and the> community development block
2-10 grant program.
2-11 SECTION 4. (a) This Act takes effect September 1, 1993.
2-12 (b) The Texas Employment Commission assumes all rights,
2-13 privileges, powers, and duties under any contract entered into by
2-14 the Texas Department of Commerce before September 1, 1993, under
2-15 Section 9A(a), Texas Job-Training Partnership Act (Article
2-16 4413(52), Vernon's Texas Civil Statutes).
2-17 (c) The property and records in the custody of the Texas
2-18 Department of Commerce on the effective date of this Act that
2-19 relate to the implementation and administration of the Texas
2-20 Job-Training Partnership Act (Article 4413(52), Vernon's Texas
2-21 Civil Statutes) shall be transferred to the Texas Employment
2-22 Commission not later than December 31, 1993.
2-23 SECTION 5. The importance of this legislation and the
2-24 crowded condition of the calendars in both houses create an
2-25 emergency and an imperative public necessity that the
2-26 constitutional rule requiring bills to be read on three several
2-27 days in each house be suspended, and this rule is hereby suspended.
