                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to class size limitations at certain grade levels in
    1-3  public schools.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 16.054(b), Education Code, is amended to
    1-6  read as follows:
    1-7        (b)  A school district may not enroll more than 22 students
    1-8  in a kindergarten, first, second, third, or fourth grade class.
    1-9  This requirement shall not apply during a <the last> 12-week period
   1-10  <weeks> of the <any> school year selected by the district.  Not
   1-11  later than the 30th day after the first day of the 12-week period
   1-12  for which a district is claiming an exemption from class size
   1-13  limitations, the district shall give written notice to the
   1-14  commissioner of education that the district is claiming an
   1-15  exemption for the period stated in the notice.
   1-16        SECTION 2.  This Act applies beginning with the 1993-1994
   1-17  school year.
   1-18        SECTION 3.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended,
   1-23  and that this Act take effect and be in force from and after its
   1-24  passage, and it is so enacted.
