                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to appointment of a bailiff for the 355th District Court.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 53.002(a), Government Code, is amended to
    1-5  read as follows:
    1-6        (a)  The judges of the 34th, 86th, 142nd, 238th, <and> 318th,
    1-7  and 355th district courts may each appoint a bailiff.
    1-8        SECTION 2.  Section 53.004(e), Government Code, is amended to
    1-9  read as follows:
   1-10        (e)  To be eligible to be appointed bailiff for the 355th
   1-11  District Court or under Section 53.001(g), a person must be at
   1-12  least 21 years old and hold a peace officer license under Chapter
   1-13  415 from the Commission on Law Enforcement Officer Standards and
   1-14  Education.  This subsection does not apply to a person serving as
   1-15  bailiff of a court described by Section 53.001(g) on September 1,
   1-16  1991.
   1-17        SECTION 3.  Section 53.007(a), Government Code, is amended to
   1-18  read as follows:
   1-19        (a)  This section applies to:
   1-20              (1)  the 22nd, 34th, 70th, 71st, 86th, 97th, 142nd,
   1-21  161st, 238th, 297th, 318th, <and> 341st, and 355th district courts;
   1-22              (2)  the County Court of Harrison County;
   1-23              (3)  the criminal district courts of Tarrant County;
   1-24              (4)  the district courts in Taylor County;
    2-1              (5)  the courts described in Section 53.002(c),
    2-2  53.002(d), or 53.002(e); and
    2-3              (6)  the county courts at law of Taylor County.
    2-4        SECTION 4.  Section 53.008, Government Code, is amended to
    2-5  read as follows:
    2-6        Sec. 53.008.  Oath.  The bailiffs of the 22nd, 34th, 70th,
    2-7  86th, 97th, 142nd, 161st, 238th, 297th, 318th, <and> 341st, and
    2-8  355th district courts, the bailiffs of the courts described in
    2-9  Section 53.002(c), 53.002(d), or 53.002(e), the grand jury bailiff
   2-10  of the 297th District Court, the bailiffs of the district courts in
   2-11  Taylor County, and the bailiffs of the county courts at law of
   2-12  Taylor County shall each swear to the following oath, to be
   2-13  administered by the judge:  "I solemnly swear that I will
   2-14  faithfully and impartially perform all duties as may be required of
   2-15  me by law, so help me God."
   2-16        SECTION 5.  Section 53.009(a), Government Code, is amended to
   2-17  read as follows:
   2-18        (a)  Each bailiff appointed by a judge of the 30th, 78th,
   2-19  <or> 89th, or 355th district court, by a district judge in Potter,
   2-20  Randall, or Taylor County, or by a judge of a county court at law
   2-21  of Potter or Taylor County is entitled to receive a salary set by
   2-22  the judge and approved by the commissioners court.  The salary is
   2-23  paid out of the general fund of the county, except in Potter
   2-24  County, where the salary shall be set by the commissioners court.
   2-25        SECTION 6.  This Act takes effect September 1, 1993.
   2-26        SECTION 7.  The importance of this legislation and the
   2-27  crowded condition of the calendars in both houses create an
    3-1  emergency and an imperative public necessity that the
    3-2  constitutional rule requiring bills to be read on three several
    3-3  days in each house be suspended, and this rule is hereby suspended.
