                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to disclosures by a real estate licensee.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 15E, The Real Estate License Act (Article
    1-5  6573a, Vernon's Texas Civil Statutes), is amended as follows:
    1-6        Sec. 15E.  Notwithstanding any provision of this Act or any
    1-7  other law, a licensee shall have no duty to inquire about, make a
    1-8  disclosure related to, or release information related to whether a:
    1-9        (a)  previous or current occupant of real property had, may
   1-10  have had, has, or may have AIDS, HIV-related illnesses, or HIV
   1-11  infection as defined by the Centers for Disease Control of the U.S.
   1-12  Public Health Service; or
   1-13        (b)  death that occurred on a property by natural causes,
   1-14  suicide, or accident unrelated to the condition of the property.
   1-15        SECTION 2.  This Act takes effect on September 1, 1993.
   1-16        SECTION 3.  The importance of this legislation and the
   1-17  crowded condition of the calendars of both houses create an
   1-18  emergency an imperative public necessity that the constitutional
   1-19  rule requiring bills to be read on three several days in each house
   1-20  be suspended, and this rule is hereby suspended.
