                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to modification of custody of a child under the Uniform
    1-3  Child Custody Jurisdiction Act.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.53(d), Family Code, is amended to read
    1-6  as follows:
    1-7        (d)  A <Except on written agreement of all the parties, a>
    1-8  court may <not> exercise its continuing jurisdiction to modify
    1-9  custody if the child and the party with custody have established
   1-10  another home state, but only if the action to modify custody
   1-11  requests modification of an order of that court <unless the action
   1-12  to modify was filed before the new home state was acquired>.
   1-13        SECTION 2.  (a)  This Act takes effect September 1, 1993.
   1-14        (b)  The change in law made by this Act applies only to
   1-15  jurisdiction of an action to modify custody that is filed on or
   1-16  after the effective date of this Act.  An action to modify custody
   1-17  that is filed before the effective date of this Act is subject to
   1-18  the law at the time the action was filed and that law is continued
   1-19  in effect for that purpose.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency and an imperative public necessity that the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
